June 2011 Man jailed for sex with 13-year-old A 20-YEAR-OLD man has been locked up for having sex with a young school girl. Craig Harvey who admitted sexual activity with a child was acquitted of rape by a jury. Harvey, of Burton Road, Swadlincote, who had sex once with the 13-year-old was sent to a young offenders’ institution for a year. Derby Crown Court heard that Harvey, who was 19 at the time of the offence, had learning disabilities and functioned “at a far younger age”. But Judge John Gosling said: “You took advantage of her, even though she wasn’t desisting and may be even encouraged you. “On the face of it, her reaction to friends was that she had enjoyed what was going on and she had no regrets. “But she was much too young to make any informed decision and it may be many years before the real impact of what you did that night becomes clear.” He said Harvey had been the victim of bullying and added: “I am realistic enough to know what custody will be like for you.” Judge Gosling said Harvey had to be punished for the crime but in his opinion he did not present a future risk to young girls. Harvey must sign the sex offenders’ register for 10 years.
