MICHAEL CUMMINGS SENTENCED IN DUNDEE FOR SEXUAL ASSAULT IN HIS HOME
A man named Michael Cummings, aged 29, has been sentenced to four years in prison after being convicted of raping a woman inside her Dundee residence.Despite the conviction, Cummings continues to assert his innocence regarding the serious allegations against him.
The incident took place on October 3, 2020, at a flat in Dundee where the victim and Cummings had been socializing earlier that evening, consuming alcohol along with other individuals.
The woman, who was intoxicated at the time, was found to be asleep or unconscious during the assault, which she later described as a violation of her personal safety and trust.
During the trial at the High Court in Edinburgh, the victim recounted waking up to find Cummings engaged in sexual activity with her.
Her testimony was a pivotal element in the case, leading to his conviction.
The presiding judge, Lord Tyre, addressed Cummings directly, stating, “You raped a sleeping woman when you were a guest in her home where she ought to have felt secure.” Judge Lord Tyre emphasized the gravity of the offense, noting that Cummings was a guest in the victim’s home, a place where she should have felt safe and protected.
The court also heard that Cummings is currently held at Perth Prison, where he has been assessed as posing a medium risk of committing further sexual offenses.
In his sentencing remarks, Lord Tyre expressed hope that Cummings would follow through on his intention to cease drug use, which was mentioned during the proceedings.
The judge’s comments underscored the importance of rehabilitation and the potential for future risk if such behavior persists.
During the trial, the defense, represented by Drew Mckenzie, acknowledged that substance abuse—specifically alcohol and drugs—may have played a role in the incident.
However, Mckenzie pointed out that Cummings has not used illicit substances while on remand in custody.
Despite maintaining his innocence, Cummings recognized that a custodial sentence was unavoidable.
Additional testimony was provided by a 24-year-old woman who was present at the flat during the incident.
She described the victim as crying and screaming after the assault, noting that she was visibly upset and pacing around the room.
The witness observed that the victim’s jeans were unbuttoned and asked if Cummings had done something to her.
The victim nodded in affirmation, confirming the assault.
As part of his sentence, Cummings has been placed on the Sex Offenders Register for an indefinite period, reflecting the serious nature of his crime and the ongoing risk he poses to the community.
