DUNDEE TRUCKER ORDERED TO REHAB AFTER ASSAULTING PARTNER
David Lopes has been instructed to participate in a domestic offenders' rehabilitation program after admitting to a violent assault.The incident occurred when a truck driver from Dundee was prompted by messages he had been sending and subsequently strangled his partner, breaking both her finger and her phone in a fit of rage.
Lopes, who has been in a on-and-off relationship with the woman for two years, attacked her after she confronted him about his communication with his ex-wife.
In her flat, he reacted aggressively when pushed, pinning her down and strangling her.
When she attempted to call for help, he broke her phone and fractured her finger during a struggle to seize the device.
Lopes was warned that failure to complete a domestic abuse rehabilitation program could lead to imprisonment.
These details were revealed at Forfar Sheriff Court.
Lopes, 42, from Dundee, appeared before the court for sentencing after reports about his background were prepared.
The court was told that his only previous conviction was related to a single driving offence.
His solicitor, David Sinclair, stated: “Mr Lopes has been advised that offences like this can warrant custody.
He expresses deep remorse for his actions.
It’s been a sobering experience for him.” Sheriff Jillian Martin-Brown sentenced Lopes to two years of supervision and ordered him to attend the Caledonian Men’s Programme.
She emphasized the seriousness of the offense, saying: “The charge involves placing your hands around the complainant’s throat and restricting her breathing, which is very serious.
A custodial sentence is a possible outcome in this case.” While noting that imprisonment was an alternative sentence, she warned: “You should be aware that if you do not attend, you could go to prison.”
