JAMES HENDERSON SENTENCED IN DUNDEE FOR SEXUAL OFFENCES AND ASSAULTS AT EDINBURGH HIGH COURT
A man aged 45, James Henderson, has been handed down a severe prison sentence of 14 years for a series of sexual offences and violent assaults carried out over a span of more than a decade in the Dundee area.The sentencing took place on Friday, 12 January 2024, at the High Court in Edinburgh, where Henderson was found guilty of multiple serious charges, including rape and attempted rape, against four women between the years 2008 and 2021.
Following a trial held at the same court in November 2023, Henderson was convicted of these heinous crimes.
The court subsequently imposed a sentence of 14 years in prison, complemented by an extended supervision order lasting four additional years, making the total potential period of supervision after release four years.
This extended sentence reflects the gravity of his offences and the risk he poses to the community.
During the sentencing hearing, Lady Haldane delivered a stern and detailed statement, emphasizing the severity of Henderson’s crimes.
She sentenced him to an overall extended term of 18 years, which includes a 14-year custodial period and a four-year license period upon release.
The court also ordered Henderson to be placed on the Sex Offenders' Register for life and prohibited him from contacting the victims directly or indirectly.
These measures are designed to protect the victims and prevent further harm.
Lady Haldane addressed Henderson directly, stating: “On 16th November 2023, you were convicted of three charges of rape involving three different women, and of attempting to rape a fourth.
Two of these women were subjected to repeated assaults.
All victims were, to varying degrees, vulnerable.
Victim Impact Statements from two of the complainants clearly illustrate the profound impact your actions have had on their lives.” She further highlighted Henderson’s extensive criminal history, which dates back to 2004, involving convictions for violence and sexual offences, some of which related to the same victims involved in the current case.
Despite previous sentences, Henderson’s pattern of offending persisted, often targeting women and frequently occurring within the context of personal relationships.
The court was presented with a disturbing criminal justice report indicating that Henderson shows no remorse and dismisses the harm caused, even expressing a distrust of women and a blasé attitude towards violence.
Henderson’s history of breaching court orders, including a sexual offences prevention order and a non-harassment order, was also noted as evidence of his blatant disregard for legal restrictions and the safety of the victims.
The court observed that his ongoing alcohol abuse is a significant factor underpinning his offending behavior.
Henderson admitted that he has no plans to cease drinking unless compelled by custody, and his anti-authority stance is reinforced by his associations with like-minded peers when at liberty.
Given the high risk of further sexual offending and potential for serious harm, the court assessed Henderson as a danger to the community.
The report suggested that a risk assessment for imposing an Order for Lifelong Restriction might be appropriate, but ultimately, the judge decided that a substantial custodial sentence combined with an extended supervision order would suffice to serve the purposes of public protection, punishment, and denunciation.
In her final remarks, Lady Haldane explained that the sentence was carefully considered, balancing Henderson’s health issues against the severity and persistence of his violent and sexual misconduct.
She emphasized that the nature of his convictions and his ongoing disregard for previous court orders necessitated a significant custodial period.
The sentence was backdated to November 6, 2021, when Henderson was first remanded in custody related to these offences.
Additionally, Henderson was granted non-harassment orders preventing him from contacting the three victims by any means, including electronic or social media, for an indefinite period.
The court also reminded Henderson of his obligations under the Sexual Offences Act 2003, which requires him to notify authorities of his whereabouts and activities indefinitely, and that his name has been added to the list of individuals deemed unsuitable to work with vulnerable groups.
