HARRY SMITH FROM MILTON KEYNES ESCAPES JAIL AFTER SEX WITH 12-YEAR-OLD IN MILTON KEYNES HOME

In December 2014, a disturbing case involving a young man from Milton Keynes drew significant attention at Aylesbury Crown Court. Harry Smith, aged 19 and residing in Browns Wood, Milton Keynes, faced serious charges related to sexual activity with a minor. The court proceedings revealed that Smith had engaged in sexual acts with a 12-year-old girl, an incident that took place within the confines of his own home while his mother and step-brother were present in the same residence.

According to court records, Smith had invited the young girl to his house after they had met through mutual friends. Upon her arrival, she observed that Smith’s mother and step-brother were also in the house. The girl and Smith then proceeded upstairs, where they listened to music together. During this visit, the court heard that the two engaged in sexual activity on three separate occasions. However, it was emphasized that because the girl was under the age of consent, she was legally incapable of giving valid consent to such acts.

Smith’s defense argued that there was no evidence of coercion, force, or grooming involved in the incident. They maintained that the girl was a willing participant in the sexual encounters. Despite this, the court acknowledged the statutory age of consent and the fact that the girl was only 12 at the time.

It was also revealed that the incident from 2012 was only reported to authorities in May of the following year. The victim had confided in her friends at school about the incident, but the details only came to light after her mother discovered messages and images of a sexual nature on her daughter’s mobile phone. The mother found the phone while saying goodnight to her daughter and noticed messages exchanged with unknown men, some of whom appeared to be from other countries.

Following this discovery, the mother sat down with her daughter to discuss what had happened. The girl denied any sexual activity with the men in the messages but admitted to having sex with Harry Smith on one occasion. She also disclosed the incident involving Smith to her mother. The mother, horrified by the revelations, visited Smith’s home and also checked the phone of another boy whose number was stored there. Smith’s mother expressed concern about her son’s interactions with younger girls and had previously advised him to remove any profiles involving minors from his Facebook account.

Harry Smith, who had no prior criminal record and was not subject to any other sex allegations, pleaded guilty to the charges at the earliest opportunity. He claimed that although he was aware the girl was younger than him, he was unaware that she was only 12 years old. The police, in turn, stated that they did not believe Smith posed a risk to other young girls.

During the court hearing, Judge Kristina Montgomery decided to adjourn the case temporarily to seek further sentencing guidance from the probation service. She expressed the view that Smith could benefit from assistance in improving his “thinking skills,” but also noted that the standard sentencing guidelines for such offenses typically mandated a minimum of six years in prison.

When the hearing resumed, Judge Montgomery sentenced Smith to 27 months in prison, suspended for three years, accompanied by a supervision order for the duration of the suspension. Additionally, Smith was ordered to sign the Sex Offenders Register for ten years and to complete an intensive sex offenders rehabilitation program. The judge remarked that her decision might not be popular but emphasized that she was opting for a suspended custodial sentence to avoid a prison term, which was the minimum under current guidelines.

She concluded her remarks by warning Smith: “Let anyone in your peer group who thinks you have been hard done by realize that actually you have been very lucky. Make sure people know it because others who commit offences of this type may not find themselves in your position.”
