DUNDEE MAN CONVICTED OF SEXUAL ASSAULT IN CRAMPED CUPBOARD GIVEN UNPAID WORK
A man convicted of carrying out a sexual assault on another man in a cramped cupboard has been ordered to perform unpaid work.Greg Baxter was found guilty of kissing the man’s neck prior to touching his chest during the incident in September 2019.
Baxter claimed during his trial at Dundee Sheriff Court that he only approached the man to return a key, not to sexually assault him.
However, the court did not accept his version of events and convicted him of two counts of sexual assault.
The 35-year-old has been placed on the sex offenders register for a year as part of a community payback order.
During the trial, the victim, who cannot be named, described feeling "frozen" when Baxter started kissing his neck and said he was "shocked" and "did not know what to do or think." He recounted wandering aimlessly afterward, and the following day, they met in a car park where Baxter asked why the man was acting "weird" before touching his chest.
The victim reported the incident, giving a statement to police.
Baxter, who was dismissed from his courier job following his conviction, denied the allegations during his evidence, claiming he only came close to the man to return a key and that his actions were not inappropriate.
He also stated that the meeting in the car park involved only discussing a financial matter.
Sheriff Tom Hughes found Baxter guilty of the incidents where he kissed the victim's neck and touched his chest without consent on September 16 and 17, 2019.
The defense lawyer described the consequences of the conviction as "catastrophic." Sentencing included 200 hours of unpaid work, registration on the sex offenders register, and supervision for one year.
