In a highly controversial case that has sparked widespread debate about police procedures and child safety, David Edwards, a 55-year-old convicted sex offender from Dundee, has been awarded over £4000 in compensation following a legal ruling that deemed the police's actions unlawful.

On a night in February 2004, police officers responded to reports of screams coming from Edwards' residence on Forres Avenue in Dundee.

Neighbors had called the authorities in the early hours, concerned about the distress signals emanating from the house.

When the officers arrived, they discovered two girls, both aged 15, inside the premises.

However, Edwards, who was visibly intoxicated at the time, refused to allow the police entry into his home, becoming verbally abusive and asserting his rights to prevent a search.

Despite their concerns for the girls' safety, the officers decided to leave without entering the property, warning the girls that their parents would be informed of their whereabouts.

Approximately an hour later, after further calls from worried neighbors, police returned to the scene.

This time, they encountered Edwards in his boxer shorts, and after a brief confrontation, they forcibly entered the house.

Upon entry, they found that the girls had already left the premises.

Edwards, who was still under the influence of alcohol, shouted at the officers, claiming, 'You’re only here ‘cos I’m a beast.' Following these events, Edwards initiated a civil action against Tayside Police, claiming that their entry into his home was unlawful.

Last week, the case was heard at Dundee Sheriff Court, where Sheriff James Scott awarded Edwards a sum of £4,000 plus interest.

The court's decision was based on the fact that the police had no search warrant and lacked the legal authority to enter Edwards' home without one.

During the proceedings, it was emphasized that police officers had acted out of concern for the safety of the two girls, given Edwards' disturbing criminal history.

Edwards, who resides on Forres Avenue in Dundee, has a long and troubling past.

In 1989, he was sentenced to ten years in prison after twice raping a schoolgirl who awoke to find him attacking her in her bed.

Prior to that, he had received an 18-month sentence for raping a 15-year-old girl.

The case has ignited outrage among politicians and child welfare advocates, who argue that the safety and well-being of children should always take precedence over legal technicalities.

Norrie Flowers, chairman of the Scottish Police Federation, expressed his disapproval, stating, 'This sends out entirely the wrong message.

These officers clearly had grounds for believing these children were at risk.

The last thing on their mind was whether they were breaching a paedophile’s rights.

The letter of the law has to be obeyed, but when it comes to child safety, we have to do the right thing.' In 2001, it was reported that Edwards was working as a window cleaner in Broughty Ferry, where residents expressed shock upon discovering that a known sex offender was peering into their windows.

His criminal record includes previous charges for breach of the peace and jostling police officers, though he was later released after claiming he was the sole carer for his elderly, ailing father and that he had been injured during police handcuffing.

These convictions were eventually quashed on appeal.

During the court hearing, a police officer recounted their prior dealings with Edwards, highlighting concerns stemming from reports of screams and his history of serious sexual offenses.

Sheriff Scott stated in his judgment, 'Had I a proper basis for doing so, I would not find in favour of the pursuer.

The police had no right of entry and no power of arrest.

In these circumstances, there being no dispute as to the law, the pursuer is bound to succeed.' Following the ruling, Tayside Police announced they would refrain from commenting until they reviewed the full judgment.

Meanwhile, political figures such as Margaret Mitchell, deputy justice spokeswoman for the Tories, and Nicola Sturgeon, SNP justice spokeswoman, criticized the decision, arguing that laws should be amended to better protect police officers in similar situations.

Child campaigner Maggie Mellon of NCH Scotland also voiced her disapproval, emphasizing that even a technical breach of law should not benefit a convicted paedophile.

William Boyle, Edwards' lawyer, defended the payout, asserting, 'Everybody has to be protected from unlawful arrest.
