DANIEL MUDIE FROM DUNDEE CONVICTED OF ASSAULTING PARTNER IN HELMSDALE PLACE
A man from Dundee, Daniel Mudie, has been found guilty of physically assaulting his partner by striking her on the head. The conviction was reached after a full day of deliberation by the jury at Forfar Sheriff Court last week.
The court's verdict clarified that Mudie’s actions did not meet the criteria for a domestic abuse aggravation, despite the nature of the assault.
Daniel Mudie, aged 41, has a troubling history of violence against former partners.
His previous convictions include a series of offences that drew significant attention, notably a violent attack that a sheriff described as being “reminiscent of a pack animal asserting dominance.” Despite a prior prison sentence, Mudie’s punishment was swiftly replaced with a community service order involving unpaid work just a few weeks later.
His upcoming sentencing for the recent assault is scheduled for June, with the court awaiting the completion of relevant reports to determine an appropriate penalty.
The recent trial centered on an incident that took place at Helmsdale Place in Dundee on July 3, 2021.
The jury found Mudie guilty of assaulting his partner by striking her on the head, which resulted in injuries.
However, the court’s verdict included significant reductions to the original charges, notably clearing Mudie of allegations that he had seized, punched, kicked, or threatened the woman during the incident.
During the proceedings, the victim provided her testimony via a video link, describing the events leading up to the assault.
It was revealed that Mudie was sober at the time of the incident, which occurred in a car in Kirkton, while his partner was intoxicated.
The court was informed that the altercation began in the vehicle, leading to the assault.
Following the verdict, Mudie’s legal representative, John Boyle, stated, “There are no other outstanding matters.
He has been of good behaviour since the events of 2021.” Sheriff Krista Johnston decided to continue Mudie’s bail and emphasized the importance of a report before making a final decision on his sentencing.
Looking back at Mudie’s criminal history, it is evident that he has a pattern of violent behaviour.
In 2018, he was sentenced to four and a half years in prison for subjecting two former partners to severe abuse.
One of the victims was choked unconscious, an act the sheriff described as “reminiscent of a pack animal asserting dominance.” In another incident, Mudie spat repeatedly on a pregnant woman and pushed her, causing her to fall onto her stomach.
Following an appeal, Mudie’s sentence was reduced by the Court of Criminal Appeal to two years’ supervision and 200 hours of unpaid work.
This decision sparked public outrage, particularly from the Women’s Rape and Sexual Abuse Centre in Dundee.
Mudie expressed remorse for his actions, stating, “I am so sorry for what I did.
It will haunt me for the rest of my life.”
