ABERDEEN MAN AVOIDS SEX OFFENDERS REGISTER AFTER PUBLIC INDECENCY
A drunken man who exposed himself and performed a solo sex act at his window has avoided being placed on the sex offenders register.Robert Hutchison carried out the indecent act in front of a full-length window at his flat on Auchmill Road in Aberdeen.
The window overlooked a public car park and a passing 17-year-old girl was shocked when she glanced up and witnessed the act.
Aberdeen Sheriff Court heard the incident occurred on March 11.
‘He does bitterly regret his behaviour’ Sheriff Christian Marney described Hutchison's actions as reprehensible, noting that he exposed himself and then proceeded to masturbate in view of a public area.
The court heard he was on medication for a heart condition and antidepressants at the time, and that he had consumed significant alcohol, which left him intoxicated.
Hutchison, now living in MacKenzie Gardens, Turriff, pled guilty to public indecency.
His defense lawyer stated that he has begun steps to address his alcohol issues, has moved to Turriff to start anew, and sees this incident as a wake-up call.
He expressed remorse and shame for his actions.
No ‘significant sexual element’ Sheriff Marney highlighted that there was no significant sexual element involved and decided that placing Hutchison on the sex offenders register was unnecessary.
Instead, the court sentenced him to 225 hours of unpaid work, three years of supervision, and ordered him to complete a rehabilitation program.
