Kevin Joseph, a supporter of the Dons football team, was involved in a disturbing incident where he filmed himself engaging in sexual activity with an unsuspecting woman in the toilets of The Foundry bar in Aberdeen and subsequently showed the footage to friends on a supporters’ bus en route to Edinburgh.

The court was informed that on August 20, 2022, a fiscal depute stated that Joseph and the woman had consensual sex in the bar's toilet, with the woman unaware of the recording.

Approximately a month later, on September 17, Joseph revealed the video to two witnesses on a supporters’ bus, indicating he had recorded the act and showing it to them.

The witnesses saw the footage but looked away, and the woman’s identity was disclosed by Joseph.

The incident caused emotional distress to the woman, and the matter was reported to the police, leading to Joseph's arrest.

In court, Joseph pleaded guilty to a charge under the Abusive Behaviour and Sexual Harm (Scotland) Act 2016, with the charge alleging he disclosed a video depicting the woman in an intimate act without her consent, intending to cause her fear, alarm, or distress.

Pleas of not guilty were accepted for voyeurism and causing a woman to view a sexual image without consent.

The sheriff noted that Joseph was 'significantly' intoxicated during the incident and considered his actions an 'isolated event,' ordering him to carry out 135 hours of unpaid work as part of a community payback order and deciding not to place him on the sex offenders register.
