December 2009 Paedophile’s appeal failed A paedophile who was caught with indecent photographs on his phone has failed in a bid to reduce his indefinite sentence. Daniel Smith, 35, of Portland Street, Mansfield, received an indefinite sentence for public protection in January after he failed to notify police of his whereabouts on numerous occasions and was caught with the four photos on his phone. These were all taken in his home. His bid to overturn the sentence was rejected by Mr Justice Saunders and Mr Justice Stadlen at London’s Appeal Court. Mr Justice Saunders said: “Smith has a long record for offences of indecency against children, among others. Because of the nature of his convictions, he has had to notify the police as to where he is living and has persistently failed to comply with the order. “The sentencing judge was clearly correct to find that Smith was dangerous. That was the clear conclusion of the various reports before the judge.” Smith must serve at least three years before the parole board will consider him for release.
