In a case that has drawn significant attention at the High Court in Edinburgh, Christine Wilson, a 25-year-old woman from Aberdeen, was spared a custodial sentence after engaging in deceptive behavior that involved pretending to be a male to gain sexual favors from teenage girls.

The court heard that Wilson’s actions, while serious, were influenced by her ongoing struggle with gender identity disorder, a recognized psychiatric condition that caused her to genuinely believe she was male rather than female.

Judge Lord Bannatyne, in delivering his verdict, expressed a degree of leniency, opting for a non-custodial sentence that included a three-year probation period and an order for Wilson to complete 240 hours of unpaid community service.

The judge described the case as “an exceptional one,” emphasizing that Wilson’s culpability was “significantly lowered” due to her diagnosed gender identity disorder.

He clarified that Wilson’s behavior was not a calculated attempt to deceive for sexual gain but stemmed from her genuine gender confusion.

Lord Bannatyne stated, “This is not a situation where you dressed up as a boy deliberately to obtain sexual intimacy with the complainers.

Rather, you always dressed as a boy.

You did not set out to harm either of the complainers.” Earlier in the proceedings, Wilson had pleaded guilty to two charges of obtaining sexual intimacy through fraud and was subsequently placed on the sex offenders’ register.

The court was informed that Wilson, at the time of the offenses, was 21 years old but had presented herself as a 17-year-old when she met a 15-year-old girl through a mutual acquaintance.

Their relationship developed into a physical one, with encounters taking place at the girl’s home and in sand dunes at Balmedie Beach, near Aberdeen.

Prosecutor Jane Farquharson detailed that the initial contact involved kissing and cuddling, but as the relationship progressed, the girl attempted to reciprocate affection.

Wilson, however, discouraged her, explaining, “I’m a giver, not a taker.” Rumors had circulated that Wilson was female, but the girl refused to believe the gossip until she was shown a copy of Wilson’s passport, which confirmed her true gender.

This revelation led the girl to end the relationship.

The court also heard about a second girl, also 15, although she told Wilson she was 16.

Wilson was 23 at the time.

The two met at an amusement park in Aberdeen and began dating, eventually becoming intimate.

When Wilson discovered that the girl was underage, she ended the relationship, explaining that it could not continue.

The girl, who was “besotted” with Wilson, struggled to accept the breakup and visited Wilson’s home, where she became ill.

Wilson responded by calling an ambulance, accompanying her to the hospital, and informing her parents.

Subsequently, police officers visited the girl and confirmed to her that Wilson was female, a revelation that shocked and upset her.

The girl found it difficult to believe the truth and struggled to come to terms with the deception, considering Wilson her “first love.” Both girls believed they were involved with a boy, unaware of Wilson’s true gender.

Throughout the investigation, Wilson admitted her guilt to the police and showed remorse during her interview, the court was told.

Her defense lawyer, Shelagh McCall, explained that Wilson had suffered from gender identity disorder from an early age and had always adopted a gender-neutral identity.

Ms McCall emphasized that Wilson had worn male clothing and engaged in male pursuits, asserting that her client had not deliberately disguised herself as a boy but had always been gender-neutral.

Wilson accepted her guilt, and her lawyer argued that the deception lay in her failure to correct the misconceptions held by the girls about her biological gender.

The court ultimately decided that her actions, while serious, warranted a lenient sentence given her mental health condition and the circumstances surrounding her behavior.
