ABERDEEN MAN FACES DEPORTATION AFTER PUBLIC SEX OFFENCE
A man named Bartlomiej Balwierz, aged 39, faced serious legal consequences after a disturbing incident in Aberdeen city centre.CCTV footage captured Balwierz engaging in sexual activity outdoors in a public place, specifically outside the bustling Union Square shopping centre.
The incident occurred in full view of pedestrians, including children and commuters, who were walking by while the couple gyrated on the ground.
According to court reports, Balwierz and his co-accused Yandu Horne had been ejected from the shopping mall moments before they sat on the pavement and proceeded to have sex.
The police were alerted after CCTV operators observed Balwierz’s exposed genitalia and captured the entire act.
During the detailed court proceedings, it was revealed how Horne initially lowered herself onto Balwierz’s lap, then moved her underwear, and both engaged in sexual intercourse while looking around, seemingly unbothered by the public.
The encounter lasted approximately 20 minutes before they finished and Balwierz, who was then aroused, stood up with his genitalia exposed again, just as children walked past.
The police quickly located and arrested the pair.
Balwierz admitted to a charge of public indecency and was placed on the sex offenders register indefinitely.
The court, considering his previous convictions including trespassing on a railway, sentenced him to 120 days in prison and emphasized that only a custodial sentence was appropriate.
Additionally, the court highlighted the significant sexual nature of the offence, which occurred in the presence of minors.
As part of his sentence, Balwierz faces the possibility of deportation from the UK following his release, given the court’s understanding of his immigration status and previous immigration issues.
His defense argued that Balwierz has no recollection of the incident, and court officials agreed that a custodial sentence was necessary due to the nature of the offence and his criminal history.
