In November 2020, Rory Harper, a 29-year-old man from Southampton, was involved in a series of serious breaches related to his status as a registered sex offender, following previous convictions for attempting to engage in sexual activity with a child and possessing indecent images of minors.

Harper’s criminal activities and subsequent legal obligations placed him under strict supervision, including a three-year community order issued by Portsmouth Crown Court on February 21 of the previous year.

This order mandated that he register as a sex offender and adhere to a Sexual Harm Prevention Order, which aimed to monitor and restrict his online and offline activities to prevent further harm.

However, police investigations revealed that Harper had failed to comply with these legal requirements.

On January 23, authorities discovered that he had not disclosed pseudonyms associated with his social media accounts, which he had set up under aliases.

This omission was a significant breach of his obligations, as it hindered police efforts to monitor his online activity.

Further complicating matters, Harper had moved from his previous address in Gosport to an undisclosed location.

When officers conducted an unannounced visit on May 10, they found that Harper had been residing at an alternative address for approximately ten weeks without informing the authorities of his change of residence.

This failure to update his address was another serious breach of his legal duties.

Prosecutor Leigh Hart emphasized to the court that Harper had not only failed to notify the police of his new address but also had multiple social media accounts that he had not declared, along with a new phone that he had acquired after disposing of his previous device without informing law enforcement.

These actions collectively represented a 'very serious breach,' as they prevented police from effectively monitoring his internet activity and ensuring public safety.

Harper’s breaches included failing to comply with the notification requirements of his sex offender registration and not informing authorities about his new contact details and online aliases.

He pleaded guilty to two counts of failing to comply with the sex register and one count of breaching his Sexual Harm Prevention Order.

Despite the gravity of these breaches, the court was informed by a probation officer that Harper was considered a ‘high risk of harm’ but was being monitored at a high level and had generally complied with the supervision measures.

The officer expressed regret that Harper had committed further offences, but also noted that he had been cooperative overall.

In sentencing, Recorder James Waddington QC made it clear that Harper would not face immediate imprisonment.

The judge acknowledged the seriousness of the breaches but decided that community-based sanctions would be more appropriate.

Harper was warned that any future breach could result in custody.
