DARLINGTON AND NEWCASTLE PAEDOPHILES SIMON CATER AND DAVID ELLIOTT SPARED JAIL OVER CHILD INDECENT IMAGES
In a recent case heard at Teesside Crown Court, two convicted sex offenders from Darlington and Newcastle have narrowly avoided immediate imprisonment after being found guilty of possessing and creating indecent images of children.Despite the serious nature of their crimes and the presence of multiple aggravating factors, both men received suspended sentences from Judge Peter Armstrong, highlighting the court's decision to impose a more lenient punishment under the circumstances.
According to prosecutor Harry Hadfield, police executed a search warrant at Simon Cater's residence in Darlington on January 25 of the previous year.
During the raid, Cater was present at his home along with David Elliott, who was found sitting on a sofa with two laptops and a mobile phone.
Both men were subsequently detained on suspicion of possessing indecent images of minors.
The police investigation uncovered a significant collection of illicit material.
In Cater’s possession, authorities discovered a total of 4,670 indecent images stored across various devices, including a laptop, several DVDs, and a USB flash drive.
Further examination revealed that Cater had employed file-sharing software to download and distribute such images from the internet, demonstrating a level of sophistication in concealing his activities.
Meanwhile, a search of Elliott’s flat in Newcastle yielded an additional 224 indecent images.
Investigators also uncovered forensic tools on his computer designed to erase traces of the images and his online activity, indicating an attempt to hide his digital footprint.
Both men admitted to 16 counts of making indecent images of children, with each also admitting to possessing such images.
Elliott, aged 54 and residing on Park Row in Newcastle, has a prior conviction for sex offences and was described as “truly remorseful” during the proceedings.
He claimed to have ceased using computers since his arrest.
Cater, aged 42 and living on Stanton Court in Darlington, had no previous convictions.
He expressed shame over his actions and showed a strong desire to seek help for what he acknowledged was a serious problem.
Judge Peter Armstrong acknowledged the severity of the offences, noting that the use of advanced technology and “anti-forensic” software to store and conceal the images represented aggravating features.
Nonetheless, he decided to suspend the sentences, citing the offenders’ remorse and the potential for rehabilitation.
As a result, Simon Cater was sentenced to six months in jail, suspended for two years, while David Elliott received a 12-month sentence, also suspended for two years.
Both men will be required to participate in sex offender treatment programs and are prohibited from working with children or having unsupervised contact with minors as part of their probation conditions.
