April 2014 Kilmarnock Rapist Jailed Again A Convicted rapist from Kilmarnock who went on the run from police has been jailed for four  months. Robert McFarlane, 47, was subject to a court order banning him from all contact with young girls after being imprisoned for a string of serious sexual offences. At Kilmarnock Sheriff Court, he admitted failing to notify officers of his whereabouts and activities between March and April last year. The high-risk offender was placed under restrictions in 2007 after being convicted and jailed for rape, assault with intent to ravish, lewd and libidinous conduct and a sex offence involving a child. December 2011 Rapist broke court order A CONVICTED rapist broke a court order barring him from having contact with girls aged under 16. At Kilmarnock Sheriff Court on Monday, Robert McFarlane, 44, was jailed for 11 months after he admitted speaking to a nine-year-old girl at his home on Christmas Eve last year. McFarlane, of Northcraig Road, Kilmarnock, pleaded guilty to breaching a sexual offences prevention order imposed at Ayr Sheriff Court in August 2007. The order prohibits him from having any contact with females under 16, except in unavoidable circumstances. The court heard that he had string of previous convictions, including rape and lewd and libidinous behaviour. Andrew Calderwood, prosecuting, said that the girl had gone to the house with her parents and 12-year-old brother. “On arrival, they all went into the livingroom,” he said. “The accused came into the livingroom and stayed for a period of about half an hour. “He made no attempt to leave or remove himself from this situation. He spoke to the children and asked them questions.” The incident later came to the attention of social workers and police. Mr Calderwood said that social workers spoke to the girl’s parents. “They didn’t know about the order,” he said. It was not until June this year that McFarlane was questioned by police. Charged with the offence, he responded: “She’s never been in my company.” Allan Kerr, defending, said that McFarlane was at home when the girl arrived with her mother and father. “I think everyone was aware of the situation,” he said. The solicitor described the sexual offences prevention order as “very strict” and very narrow”. Mr Kerr said: “He understands he should have left immediately. He failed to do so. “He explains it is very difficult, awkward and embarrassing, to say the least.” McFarlane’s position was that he had left after 15 minutes. “He excused himself saying he had messages to get at Tesco,” said his lawyer. Mr Kerr stressed that the girl had been in the company of other adults throughout the incident. “It is, in my submission, a technical breach of the order,” he said. He asked Sheriff Seith Ireland to consider releasing McFarlane on bail, pending a background report. Passing sentence, the sheriff said that the offence was not at the highest level of a breach of a sexual offences prevention order – such as “being found … in a public park where young people were playing”. He told McFarlane, however, that a custodial sentence was necessary to remind him that he “must always disengage himself from the company of youngsters as soon as it happens”.
