MALCOLM GROGAN, RETIRED WORCESTERSHIRE MAN, AVOIDS JAIL DESPITE CHILD SEX OFFENCE IN DEVON
In March 2011, Malcolm Grogan, a 74-year-old retired postman from Worcestershire, was spared imprisonment after sexually assaulting a 12-year-old girl at a holiday park near Barnstaple, Devon, in August of the previous year.Grogan, formerly of Old Orchard, Upton-upon-Severn, appeared before Exeter Crown Court where he pleaded guilty to one count of sexual assault of a child. He was sentenced to a three-year community order that includes supervision and rehabilitation requirements. Additionally, he is required to sign the sex offenders’ register for five years.
This is not Grogan’s first conviction involving sexual offenses. In May 2004, he was sentenced to nine months in jail for sex attacks on a 10-year-old girl at a swimming pool in Tewkesbury. During that hearing at Hereford Crown Court, it was revealed he had fondled and kissed the victim’s chest. Following this conviction, Grogan admitted to two counts of indecent assault and was ordered to register as a sex offender for life.
The recent incident in Devon came to light when the 12-year-old victim told her mother about the assault, which was also recorded on CCTV. The victim’s mother, who cannot be named for legal reasons, described the sentence as “diabolical” and expressed her disbelief at not seeing prison time for Grogan.
“I just cannot understand why he has not been locked up,” she said. “He was sent to jail the last time he offended, so why has he been allowed to walk free this time? He is in his 70s now. I can’t see how any supervision or rehabilitation order is going to work—he is a danger to the public. What is to stop him from going into a supermarket and doing something similar? It was a shocking experience for my daughter, and other children need protecting from these types of offenses.”
At his 2004 sentencing, Grogan told the judge that he had been married for 44 years and had a supportive family. Despite his history, the court opted for a community-based sentence this time.
