June 2010 Parents’ disgust at sex case sentence THE parents of an 11-year-old girl spoke of their “disgust” after a man who had sex with their daughter escaped a prison sentence on Friday of last week. Jonathan Mark Fenwick, then aged 19, climbed to the girl’s bedroom at her invitation before having sex with her in the early hours of August 8, last year. Durham Crown Court heard he was joined by a friend who had sex with the girl’s older sister. The two couples were interrupted by the girls’ mother. Fenwick fled out the window. He later handed himself in, and admitted having sex but said he thought the girl was older. Fenwick, now 20, of Eldon Close, Langley Park, admitted a statutory offence of rape of a girl under 13, on the basis that he thought she was 16. Judge Christopher Prince found in Fenwick’s favour at a trial of the issue after hearing that the girl had sent him explicit texts that would not be expected of an 11-year-old. The court was told she began to text him after seeing his business telephone number on his car valeting business work van. Judge Prince described Fenwick as “naïve”, but said “the likelihood of a repeat is zero”. He imposed a 12-month community order with probation supervision. Fenwick was also placed on the Sex Offenders’ Register. The girl’s mother said: “It’s disgraceful. It’s obvious she looked 11 years of age.”
