    SWADLINCOTE PAEDOPHILE CHRISTOPHER MASSINGHAM ESCAPES JAIL DESPITE HAVING 771 INDECENT IMAGES

    In a case that has shocked the community of Swadlincote, Derbyshire, 41-year-old Christopher Massingham was spared a prison sentence despite possessing a significant collection of indecent images of children. The court heard that police discovered a total of 771 such images stored across various devices belonging to Massingham, raising serious concerns about the extent of his offending.

    Massingham, who resides on Dundee Road in Swadlincote, faced multiple charges related to the making and possession of indecent images. Specifically, he pleaded guilty to seven out of twelve charges, which involved images found on his computer's hard drive, an MP4 player, and several CDs. The images were classified as the lowest category of seriousness, which influenced the court's decision to avoid a custodial sentence.

    During the proceedings at Derby Crown Court, Recorder William Coker QC explained that although the images were of a sexual nature involving children, they did not depict sexual activity. The court was informed that the images included photographs of children under the age of ten, as well as adolescents, in various poses and states of dress. The images ranged from explicit to more benign, but all were considered to be of a sexual nature.

    Initially, Massingham denied any knowledge of the images and attempted to shift blame onto others. Prosecutor Stephen James stated that Massingham was arrested in November 2007, but it was only shortly before his trial, scheduled to begin in February 2009, that he admitted guilt to seven charges. The police investigation revealed that the images were stored in multiple locations: 492 images on a CD in seven folders, 509 images on an MP4 player, and additional duplicates across these media.

    The prosecution highlighted that the exact number of images possessed was uncertain due to duplication across devices. In mitigation, Stuart Newsam argued that Massingham’s offending stemmed from a period in his life that he deeply regrets. He emphasized that Massingham was motivated to seek help and acknowledged that his lifestyle at the time was unhealthy and influenced by the use of adult pornography, which he claimed led to these troubling behaviors.

    Despite the guilty plea, Recorder Coker made it clear that Massingham had narrowly avoided a custodial sentence. The judge warned that if he were found in possession of more serious images in the future, he could face a lengthy prison term. The court also ordered Massingham to register as a sex offender for five years and imposed a seven-year sexual harm prevention order to protect the public from potential future harm.

    Additionally, the court could not reach a verdict on five remaining counts, which will now be kept on file. The case underscores the ongoing concerns about child exploitation and the importance of rigorous legal measures to prevent such offenses from recurring in communities like Swadlincote.
