WAYNE ELWICK FROM MIDDLESBROUGH SENTENCED TO SIX YEARS FOR RAPE IN DISTURBING CASE

In a case that has shocked the community of Middlesbrough, Wayne Elwick, aged 29, has been sentenced to six years in prison after being found guilty of raping a 16-year-old girl.

The incident took place during the early hours of June 16 last year, when the victim was at Elwick’s flat in Middlesbrough.

The court heard that the girl, who was under the influence of alcohol and was feeling tired, was initially in the company of friends and other individuals.

She decided to leave around 4:30 am, feeling ready to go home.

According to the prosecution, another man at the flat had consensual sex with the girl earlier that night.

However, the situation took a dark turn when she fell asleep and later woke up to find Elwick undressing her.

The court was told that she immediately reacted by slapping him twice and pleading, “get off me, please get off me.” Despite her protests, Elwick did not stop and proceeded to commit the assault, which was classified as rape.

When the girl screamed for help, her cries attracted the attention of others in the flat.

Elwick responded with verbal abuse and quickly jumped up, leaving the scene.

The victim, who cannot be named for legal reasons, was visibly shaken and distressed.

She left the premises crying and trembling, then returned home and promptly confided in her father about the assault.

The court emphasized that her vulnerability was compounded by her intoxicated state and the circumstances of the night.

Following his arrest, Elwick provided a series of inconsistent accounts of the events.

Initially, he denied any wrongdoing, claiming that nothing had happened and that he did not have sex with the girl — a claim that was conclusively disproved by forensic evidence.

He then suggested he could not remember the incident, later hinted that there might have been some contact, and finally claimed that the sexual activity was consensual.

During the trial, Elwick also alleged that the girl had mocked his sexual performance and had expressed willingness to have sex with him and another man earlier that evening.

These claims were dismissed by the jury and the judge, Recorder Martin Bethel QC, who stated that such allegations only worsened his case.

Judge Bethel highlighted that Elwick’s actions were particularly egregious given the girl’s vulnerable state, noting that she was intoxicated, tired, and unable to refuse his advances.

The court found that Elwick had taken advantage of her condition after consuming alcohol over a prolonged period and using drugs.

The judge underscored that the girl had made it clear she did not want or expect any sexual contact from Elwick, and her protests were ignored.

Elwick’s criminal history included previous convictions for domestic violence assaults involving physical violence, but this was his first conviction related to sexual offences.

The court also heard that Elwick had stood trial twice; the first ended with a hung jury, but he was convicted in the second trial.

The guilty verdict sparked a disturbance in the public gallery, with two women being refused entry to the court building after becoming overwhelmed with emotion and apologizing for their reactions.

In addition to his prison sentence, Elwick was issued a restraining order that prohibits him from contacting the victim or approaching within 500 meters of her or her residence.

He will also be registered as a sex offender indefinitely.

His defense argued that he should not face an excessively harsh sentence, claiming there was no evidence he knew the girl’s exact age and expressing concern about the impact on his family, including his long-term partner and two children, as well as his two ill grandmothers.

Nonetheless, the court’s decision reflects the seriousness of the offence and the need to protect vulnerable individuals from predatory behavior.
