SZCZEPAN MALCZEWSKI JAILED FOR HORRIFIC RAPE IN NORTH YORKSHIRE SCARBOROUGH PUB
Szczepan Zenon Malczewski, aged 38 and a resident of Eastfield, North Yorkshire, was initially sentenced to two years and nine months in prison on August 2, 2024, at York Crown Court after admitting to the heinous crime of rape and sexual assault by penetration against a young woman.The assault took place in a pub toilet located in Scarborough on the evening of May 7 this year.
Following the sentencing, the victim—whose identity remains protected for legal reasons—was represented by Detective Constable Nick Burton, who made an application to the Attorney General’s Office under the Unduly Lenient Sentence scheme.
This move prompted a review of the case by the Court of Appeal, which convened a hearing on Tuesday, October 22, 2024.
During this hearing, Lord Justice Bean, Mr.
Justice Sweeting, and Her Honour Judge De Bertodano collectively decided to overturn the original sentence.
They replaced it with a significantly harsher prison term of six years.
The judges emphasized that the initial sentence failed to adequately account for the profound psychological trauma inflicted upon the victim, as well as her vulnerable state at the time of the attack.
The court’s decision underscores the severity of the crime and the importance of appropriate sentencing to reflect the harm caused.
Details from the court report dated August 2, 2024, reveal that the incident was described as a “horrendous” attack.
Malczewski’s actions in the pub toilet shocked the community and led to his immediate arrest.
The assault occurred around 10:40 pm in the town centre pub, where the victim, an early 20s woman, had been socializing with friends before they left for home.
Malczewski followed her into the restroom and refused to let her leave, subsequently forcing himself upon her for approximately ten minutes despite her repeated pleas for him to stop.
Police officers responded swiftly to the scene, apprehending Malczewski nearby.
The victim received urgent specialist care and support from police and partner agencies, including the Sexual Assault Referral Centre.
The investigation was led by Detective Constable Nick Burton, who meticulously gathered evidence, including forensic data and crucial CCTV footage from the communal area of the toilets.
DC Burton explained that the CCTV footage clearly depicted Malczewski’s movements and aggressive behavior leading up to the assault.
The footage also showed his hostile demeanor when staff members helped the victim out of the toilets.
The victim was left in a state of collapse following the attack, highlighting the brutality of the incident.
Malczewski later admitted during police interviews that the victim had not consented at any point and expressed shame upon viewing the CCTV footage of his aggressive conduct.
DC Burton emphasized the victim’s bravery throughout the ordeal and expressed hope that the increased sentence would provide her with some sense of justice.
He reaffirmed the commitment of North Yorkshire Police and partner agencies to support victims and ensure offenders are held accountable.
