SERBAS MOHAMMED ON ISLE OF WIGHT ESCAPES JAIL DESPITE SEXUAL OFFENCES AND SCHIZOPHRENIA DIAGNOSIS
In a case that has shocked the Isle of Wight community, 31-year-old Serbas Mohammed faced serious allegations of sexual misconduct involving two young girls.The incidents reportedly occurred in 2022, when the victims were just 15 and ten years old.
According to court proceedings, Mohammed engaged in inappropriate behavior during a single encounter, which included him kissing one girl on the cheek and neck, progressively moving closer each time she tried to distance herself.
Additionally, he was observed to have massaged the thigh of his other young victim and asked her to give him a massage, actions that caused significant distress.
The case came to light after one of the victims confided in a friend about the incident, which was subsequently reported to her school authorities.
The distress caused by the events was evident in a statement read aloud during the court hearing, where one of the girls expressed the profound impact the experience had on her.
She stated, “This incident has had a big impact on me.
I felt a lot of anger.
I have also been unable to go to school properly.
I have been struggling with my mental health.
Struggling to sleep.” Throughout the legal process, Mohammed maintained his innocence, denying all allegations.
However, in June, a jury convicted him of two counts of sexual activity with a child.
The court was informed that following concerns raised during the trial, a psychiatric assessment was conducted, which resulted in Mohammed being sectioned and diagnosed with schizophrenia.
As part of his ongoing treatment, he now receives regular injections to manage his mental health condition.
His legal representative, Thomas Evans, expressed concerns about the adequacy of his treatment in prison, noting that Mohammed’s condition might not be properly monitored if incarcerated.
Mohammed, who resides at Market Place, Newport, Isle of Wight, was sentenced on a Friday to 15 months in prison, suspended for two years.
The court also mandated that he complete up to 40 days of rehabilitation and adhere to a 12-month mental health treatment requirement.
Furthermore, he was ordered to register as a sex offender, and a sexual harm prevention order, along with a restraining order, was imposed for the next ten years.
Judge Brian Forster KC acknowledged the severity of the case, stating, “What took place has had a considerable impact.
I have no doubt that the case crosses the custody threshold.” The judge emphasized Mohammed’s diagnosis of schizophrenia, describing it as a challenging mental health condition.
He noted that Mohammed had previously spent time in hospital earlier that year and had been compliant with his treatment plan.
The judge expressed concern that sending Mohammed to prison at this stage could hinder his rehabilitation and negatively affect public safety, stating, “If you are sent to prison today that will be a major step back in your rehabilitation which will affect not only you but also the public.” Prosecutor Ellie Fargin highlighted that Mohammed had prior convictions for a public order offence and making threats to kill, adding context to his criminal history.
However, Evans pointed out that Mohammed’s situation had significantly improved since the initial court appearance, attributing this change to the criminal proceedings and his ongoing treatment.
He explained that Mohammed, who came to the UK as a youth with preexisting trauma, has shown notable progress and that his mental health challenges are complex and rooted in his background.
The court’s decision reflects a nuanced approach, balancing the seriousness of the offences with the recognition of Mohammed’s mental health condition and efforts at rehabilitation.
