SCOTT FITZGERALD SHOCKING SEX OFFENDER CASE IN JERSEY
In a case that has sent shockwaves through the community of Jersey, Scott Fitzgerald, a 41-year-old British Army medic, has been convicted of heinous sexual offenses against a young girl and possession of indecent images of children.Fitzgerald appeared in the Royal Court where he received a lengthy sentence of three years and ten months behind bars.
The court was told that Fitzgerald’s crimes came to light through an investigation involving online activity.
Crown Advocate Matthew Maletroit explained that the offending was uncovered after Fitzgerald engaged in a conversation with an undercover police officer from the United Kingdom.
The officer was posing as a fellow sex offender under the pseudonym Chris on an instant messaging platform.
During the course of their interaction, Fitzgerald inadvertently revealed details of his sexual interest in children.
He believed he was speaking to someone who shared similar intentions and even claimed to have a young daughter willing to meet him for sexual activity.
The most serious charge involved Fitzgerald’s touching a girl under the age of ten in a sexual manner.
This incident occurred while Fitzgerald was on leave from the British Army.
The court was informed that during their online exchange, Fitzgerald described the incident as “tickling,” claiming that the child loved it.
Authorities confirmed that Fitzgerald had also sent images of the girl’s underwear to the undercover officer.
The victim, referred to in court as Child X, was interviewed by authorities, and she recounted that Fitzgerald had engaged her in a “little tickle.” Following Fitzgerald’s arrest on suspicion of sexually touching the young girl, further investigations revealed additional disturbing evidence.
On his phone and laptop, police found a total of ten indecent images of children, though one was a duplicate, making the overall count nine.
The images depicted children in sexually explicit contexts and added to the case against Fitzgerald.
During proceedings, Crown Advocate Maletroit highlighted that Fitzgerald’s actions in positioning and tickling the child suggest a clear intent to obtain sexual gratification.
The court heard that Fitzgerald demonstrated a troubling pattern of behavior.
During interviews with the Probation Service, as well as psychologists and psychiatrists involved in compiling background reports, Fitzgerlad struggled to accept responsibility for his conduct.
Instead, he claimed that he had fabricated a story to participate in the chatroom, believing it was a way to catch other offenders and correct what he saw as a wrong.
The prosecution also presented further evidence implicating Fitzgerald in additional misconduct.
This included the discovery of 31 more indecent images on a device found in his accommodation in the UK, along with online chat logs suggesting he sought further sexual contact with other children.
Based on these findings, the Crown recommended a prison sentence of four years and urged the court to impose measures restricting Fitzgerald’s contact with children under 16 years of age, as well as curbing his internet usage.
Fitzgerald’s defense, represented by Advocate Luke Sette, argued that a four-year term was excessive.
While acknowledging the gravity of the sexual touching charge, his lawyer described the offense as relatively minor within the broader context of sexual crimes and portrayed Fitzgerald as a troubled individual in need of help.
Sette emphasized that Fitzgerald had attempted suicide in prison and was now seeking rehabilitation.
The case was heard by a panel of five Jurats—Austin-Vautier, Christensen, Blampied, Ramsden, and Thomas—who only convene for the most serious cases.
When delivering the verdict, the Deputy Bailiff addressed Fitzgerald directly, emphasizing the court’s concern about his sexual interest in children and noting his minimization of the severity of his actions.
Given the nature of his offenses and the risk he poses, the court sentenced Fitzgerald to nearly four years in prison.
In addition to his custodial sentence, Fitzgerald will remain on the Sex Offenders Register for at least ten years, and a restraining order was issued to prevent him from ever contacting his victim again.
The court’s decision reflects the serious view taken of his crimes and underscores the ongoing efforts to protect children from such predatory behavior in Jersey.
