MALCOM DOWN JAILED FOR SEXUAL ABUSE IN SALTASH AFTER 40 YEARS
In a case that has spanned over four decades, a man from Saltash has been sentenced to prison for sexually abusing a teenage boy many years ago.Malcom Down, aged 75, appeared before Truro Crown Court to face charges related to his past misconduct.
He pleaded guilty to three counts of indecent assault, which involved his young victim during a period more than 40 years in the past.
Details of the case revealed that the abuse took place when Down was actively involved as an assistant leader at a local youth club in Saltash.
The victim, who chose to come forward only after the death of his mother last year, described the profound and lasting impact that the assault had on his life.
According to the prosecutor Llewellyn Sellick, the victim’s statement highlighted that the trauma from the abuse had led him to live a life characterized by isolation and loneliness, especially in terms of personal relationships, for over four decades.
During the court proceedings, defense counsel Siobhan Molloy emphasized Down’s contributions to the community, noting his lifelong dedication as a hard worker and his involvement in various charitable activities around Saltash.
She also pointed out Down’s ongoing health issues, including recent heart and prostate surgeries, and requested that any prison sentence be suspended, citing his poor health and the positive character references he had received.
Judge John Neligan acknowledged the mitigating factors, including Down’s guilty plea which spared the victim from further court proceedings and cross-examination.
The judge also recognized Down’s medical conditions, lack of prior convictions, and the commendations from community members about his voluntary work.
However, the judge emphasized that the nature of the crime was extremely serious, especially given the victim’s age at the time of the abuse.
While noting that there was no evidence of Down posing a significant risk to others and that he had not committed similar offences in the past 40 years, Judge Neligan stated that the gravity of sexual offences against young teenagers necessitated immediate custody.
Consequently, Down was sentenced to 18 months in prison.
Additionally, he was ordered to register as a sex offender for the next ten years, underscoring the court’s stance on the severity of such crimes and the importance of public safety.
