    A man from Kirkcaldy, Kevin Sinclair, has been convicted by a jury of serious child abuse charges, including physically assaulting children and unlawfully restraining them with cable ties. The case, which unfolded over a four-day trial at Kirkcaldy Sheriff Court, revealed disturbing details about Sinclair’s treatment of young victims over nearly a decade.

    Sinclair, aged 44, vehemently denied all allegations, which included multiple counts of assault and wilful ill-treatment of children between the years 2009 and 2018. Despite his denials, the jury found him guilty of five specific charges after considering the evidence presented. The court heard that Sinclair had physically struck one child multiple times with a belt, targeting their head and body in a pattern of repeated abuse that spanned almost ten years, beginning in 2009.

    In addition to this, Sinclair was convicted of assaulting three other children in a similar manner, involving physical blows to their bodies and heads. The jury, however, returned verdicts of 'not proven' on allegations involving two other children, meaning the evidence was insufficient to establish guilt beyond a reasonable doubt in those cases. The allegations concerning injuries sustained during these assaults were dropped, but the core charges related to the physical abuse and the use of restraints.

    One of the most disturbing aspects of the case involved Sinclair’s use of cable ties or similar bindings to restrain the children. The jury found that Sinclair had repeatedly bound the children’s hands behind their backs with these ties, forcing them into kneeling positions on the floor. The evidence indicated that these acts were carried out over an extended period, with the majority of jurors agreeing that Sinclair’s actions constituted wilful ill-treatment, likely to cause unnecessary suffering or harm to the children’s health. Despite the severity of the accusations, Sinclair was cleared of forcing the children to eat off the floor while their hands were tied.

    For legal reasons, the children involved cannot be named publicly. The case took a further turn when police were called after Sinclair’s interview with Barnardo’s, an organization that had been discussing his own childhood. During this interview, Sinclair reportedly admitted to giving the children “a wee dunt here and there,” which raised alarm bells among authorities. Claire Bremner, the fiscal depute, explained that Sinclair’s comments prompted police intervention. She also noted that Sinclair’s previous criminal record was limited to a 2002 assault, which was dealt with through admonition, and a 2006 conviction for driving without insurance.

    Judge Alastair Brown deferred sentencing until March to allow for reports to be prepared. He described Sinclair’s remarks to Barnardo’s as “very disturbing” and expressed concern over the lack of recognition from Sinclair that his actions were abusive. The sheriff emphasized that some of the evidence was particularly alarming and criticized Sinclair’s attitude, which appeared to lack remorse or acknowledgment of the harm caused.

    Despite the gravity of the case, Sinclair was released on bail with specific conditions, and the sheriff made it clear that a prison sentence was not guaranteed at this stage. The court’s decision reflected the complexity of the case and the need for further reports before final sentencing can be determined.
