KEVIN PAYNE AND SHOCKING SEXUAL OFFENCES IN BRADFORD AND HARROGATE

A 67-year-old man named Kevin Payne has been sentenced to more than two years in prison after being convicted of performing a lewd act near a children’s play area, an incident that took place in Harrogate.

Despite having been subjected to a strict court order that prohibited him from approaching children’s recreational areas, Payne’s illegal behavior unfolded in stark violation of these restrictions.

On June 12, Payne parked his vehicle in Valley Gardens, a well-known park in Harrogate, and then proceeded to a wooded section in the vicinity of a children’s playground.

According to testimony heard in York Crown Court, a passer-by noticed Payne engaging in a lewd act in the woods overlooking the playground.

The witness described being startled as they observed Payne through a gap in a hedge, immediately recognizing the troubling nature of his conduct.

As soon as Payne saw himself being spotted, he ran away from the scene, but not before the passer-by took immediate action.

Pursuing him on foot, the witness managed to photograph Payne during the chase and eventually detained him until police arrived at the scene.

The incident prompted a swift arrest, and Payne was taken into custody.

In the police station, Payne admitted to violating the sexual-harm prevention order issued against him, which explicitly forbade him from entering within 100 meters of any recreational area where children are likely to be present.

Despite his acknowledgment of breaching this order, he contested the charge of outraging public decency by performing an indecent act, which the court ultimately found proven.

Payne, a resident of Bradford, was scheduled to face trial for these offences on the day he admitted guilt.

It later emerged during the trial that the incidents in Harrogate occurred while he was under investigation for possessing and viewing indecent imagery online.

Police had arrested him in December of the previous year after routine monitoring visits aimed at ensuring his compliance with the court order.

During this investigation, officers found that Payne had searched the internet for sexual images involving children, including an explicit, Category A-rated photograph depicting a child — an image classified as among the most severe in terms of content.

Further examination of his devices revealed six images of extreme pornography, including material involving bestiality.

Following these discoveries, Payne admitted to possessing indecent images of children and six extreme pornography images.

Previously, in June of the previous year, he had been sentenced to six months in prison for making such indecent images and was released in January this year.

However, after his release, he committed the recent offences in Valley Gardens.

Throughout his lengthy criminal history, Payne has accumulated a record comprising 51 offences over 40 years.

His criminal activities include numerous instances of indecent exposure in front of young girls, voyeurism, kerb-crawling, sexual activity in the presence of a child, and other serious offences related to violence, harassment, public disorder, and breaches of court orders.

Due to the dangerous nature of his repeated conduct, multiple judges had previously imposed extended prison sentences.

During the sentencing hearing, the prosecution outlined Payne’s extensive prior record, emphasizing the pattern of offending that underscores his dangerousness.

In defense, barrister Derek Duffy argued that Payne did not intentionally seek to be observed in Valley Gardens when he committed the lewd act.

Duffy mentioned that Payne, a retired man formerly residing on Ling Park Avenue, Bingley, had lost his accommodation and was planning to live with a friend in Harrogate upon his release from prison.

Duffy described Payne as a man who had lost contact with his family and now presented as a despondent individual.

The presiding judge, Simon Hickey, condemned Payne’s actions, stating that the latest offences in Valley Gardens were “quite revolting.” He expressed concern over the fact that Payne, at 67 years old, continued to commit such offences.

Judge Hickey pointed out the disturbing aspect that no children saw the incident, but emphasized the seriousness and inappropriateness of such behavior.

In a court ruling, Payne was sentenced to 27 months in prison but is expected to serve only half of that term before being eligible for release on license.

Additionally, he was ordered to register as a sex offender for ten years, and the existing sexual-harm prevention order will remain in effect to restrict his movements further.

Finally, the court recognized the courageous efforts of the witness who chased and detained Payne.

As a reward for his “very public-spirited” actions, the witness received a payment of £150 from public funds, highlighting the importance of community vigilance and intervention in cases of public and sexual safety.
