January 2016 Dad tracks down pervert who exposed himself to boy, 13 A FATHER turned detective and tracked down a pervert who had committed a sex act in front of his young son. Bolton Crown Court heard how the 13-year-old schoolboy’s description of Kevin Duffy was so good that his dad recognized him as a man whom he knew drank in a local pub. At Bolton Crown Court, 59-year-old Duffy, who pleaded guilty to engaging in sexual activity in the presence of a child, was sentenced to a three year community order and told he must undertake a sex offenders’ programme. David James, prosecuting, told the court how the teenager was visiting Bolton Market after school at 3.30pm on September 25 2014 when he needed to use the toilet. He saw Duffy come out of a cubicle in the traders’ toilets and the man was still there, standing by a urinal, when the boy came out of a cubicle himself. But then Duffy, of Paderborn Court, Bolton, turned around and carried out a sex act in front of the child. “The boy was frightened and scared and ran immediately from the toilet and went and told his father,” said Mr James. He added that, upon hearing his son’s description, the father suspected the offender was a man who he knew worked for First Buses and who drank in a nearby pub in afternoons. He took his son to the pub, who was able to positively identify Duffy, and he was arrested. Duffy, who the court heard had a previous criminal record for indecent exposures in 1979, 1981 and 1995, initially denied committing the offence, telling police he was simply urinating and was not aware that a child was there. Colin Buckle, defending, described Duffy as an isolated man without friends or family and, appealing to Judge Graeme Smith not to impose a prison sentence, stressed that the defendant had not followed the boy into the toilet or targeted him. Passing sentence, Judge Smith told Duffy that there are underlying issues behind his offending. But he added: “I accept there is no evidence that you targeted him in any way. At worst you took the opportunity to behave in this way in his presence.” Judge Smith stressed that if Duffy does not co-operate with the supervision during his community order then he will face an “inevitable prison sentence”. “The public are best protected by you being given an opportunity to address what is causing this sporadic behaviour,” Judge Smith told him. Duffy was also placed on the sex offenders’ register for five years and a sexual harm prevention order was made banning him from going to Bolton Market and entering public or traders’ toilets there for five years.
