    A man responsible for the tragic and violent death of his girlfriend in Dundee has been formally sentenced to life imprisonment, with a minimum term of 17 years before he can be considered for parole. Kenneth Melville, aged 59, was convicted of the murder of his partner, Yvonne Barr, following a series of severe domestic violence incidents that culminated in her death on 5 November 2021.

    Melville’s violent assault took place at her flat in Dundee, where she had been living under the care and support of Scottish Women’s Aid. The attack occurred in the early hours of that day, after Melville had returned to her residence around 2 a.m. following a day of various outings. According to court records, Ms. Barr, who was 47 years old at the time, was a vulnerable individual, using a walking stick and a Zimmer frame, and had recently been allocated accommodation in Dundee by Scottish Women’s Aid. Her family, including her parents, brother, and son, were present in court, and her mother’s heartfelt impact statement was read aloud during the sentencing.

    On the night of the attack, Ms. Barr had sent multiple distress signals via text messages to a Scottish Women’s Aid worker’s work phone at 3:26 a.m., indicating her distress. Shortly thereafter, Melville launched a brutal assault on her, having consumed crack cocaine, heroin, and street Valium earlier that night. Court evidence detailed that Melville placed his hands around her neck, applying pressure, although he later claimed not to recall this specific act. He also punched, kicked, and inflicted blunt force trauma upon her head and body. Witnesses and paramedics described her injuries as catastrophic, with extensive head and facial injuries, including swollen and bruised eyes, ears, and an open wound at the back of her head. Blood and cerebrospinal fluid were observed emanating from her ears, and her airway was displaced, rendering her unconscious and not breathing.

    Paramedics arrived at the scene at approximately 5:52 a.m., finding Ms. Barr in a critical state. She was transported to Ninewells Hospital, where she was pronounced dead at 2:30 p.m. The forensic examination revealed that her death resulted from unsurvivable brain damage caused by a combination of severe head and neck injuries. The injuries included bilateral subdural hematomas, subarachnoid hemorrhage, cerebral edema, and diffuse traumatic axonal injury. Fractures to her nasal bones, thyroid cartilage, and spinous processes of her neck were identified, along with multiple rib fractures and a spiral fracture of her left thigh, the latter attributed to Melville’s assault.

    Throughout his life, Melville had accumulated seven previous convictions, though he had never served a custodial sentence before. Only one of these convictions was related to domestic violence. His legal history was characterized by limited criminal activity, and he was described by counsel as having entered the drug culture later in life, with employment as a printer prior to his criminal behavior. The court acknowledged his participation in resuscitation attempts and the early plea of guilty, which contributed to the sentencing decision.

    During the sentencing hearing, Lord Arthurson emphasized the gravity of Melville’s crime, noting that the murder was committed while Melville was under the influence of illegal substances and in the context of ongoing domestic violence. The judge highlighted the brutality of the attack, which involved punching, kicking, and blunt force trauma, leading to Ms. Barr’s death. The court also took into account the prolonged history of violence and threats, which Ms. Barr had endured over several months, and her vulnerable status at the time of her death.

    In his remarks, Lord Arthurson explained that the law mandates a life sentence for murder, with the court setting a minimum period—known as the punishment part—that Melville must serve before being eligible for parole. The court fixed this period at 17 years, with one year of that attributed to aggravation under the 2016 Abusive Behaviour and Sexual Harm (Scotland) Act. The sentence was backdated to November 8, 2021, the day Melville was first remanded into custody. The judge also noted that had Melville not pleaded guilty, the punishment part would have been set at 20 years.

    In conclusion, the court’s decision reflects the severity of the crime, the vulnerability of the victim, and the need for justice in the face of such a brutal act of domestic violence in Dundee.
