DARLINGTON MAN KEITH TOLSEN CAUGHT AGAIN WITH CHILD INDECENT IMAGES IN DARLINGTON
In a case that has once again brought the issue of online child exploitation to the forefront, Keith Tolsen, a resident of Darlington, was found guilty of possessing indecent images of children for the second time.The incident, which took place in Darlington, has raised serious concerns about the effectiveness of rehabilitation and the ongoing threat posed by individuals with such offenses in the community.
In November 2015, police executed a raid on Tolsen's former residence located on Alverton Drive in Darlington.
The operation was initiated after authorities received credible information indicating that electronic devices linked to the property had been involved in downloading and storing indecent images.
During the raid, officers discovered that a woman, who had been in a relationship with Tolsen, was present at the property but had noted that he had left the premises four weeks prior to the search.
Further investigations led police to another address where they seized Tolsen's laptop and mobile phone.
Analysis of these devices revealed the presence of 23 images and videos depicting child abuse, including both still photographs and moving images.
When questioned, the 55-year-old defendant claimed that other individuals might have had access to his devices and could have been responsible for the illegal content, suggesting a possible defense based on third-party access.
It was also revealed that Tolsen had a prior conviction dating back to 2009, when he received a 36-week prison sentence, suspended for two years, for possessing and distributing indecent images of children.
This history underscored the ongoing nature of his offending behavior and the challenges faced by the justice system in managing such offenders.
During the sentencing hearing, prosecutor Rachel Masters outlined the details of the case, emphasizing the seriousness of the offense.
The court was informed that Tolsen had admitted to three charges of making indecent images of children at an earlier hearing.
The defense, represented by Andrew Finlay, argued that none of Tolsen's offending involved direct contact with children, attempting to mitigate the severity of his actions.
In a significant decision, Judge Simon Bourne-Arton, QC, opted to suspend a 12-month prison sentence for two years, instead imposing a 35-day requirement for rehabilitation activities.
The judge stated that Tolsen would not benefit from incarceration, as he believed the defendant would not receive the necessary help behind bars and that both the community and Tolsen himself would be better served if he remained in the community under supervision.
The judge remarked, “There are potentially some signs of you appreciating the problem you have,” but also acknowledged the harm caused to victims, emphasizing that children depicted in such images are forced into abusive acts for the gratification of offenders like Tolsen.
Furthermore, the court imposed a Sexual Harm Prevention Order, which prohibits Tolsen from having unsupervised contact with anyone under the age of 16 and restricts his internet usage to prevent further offenses.
Judge Bourne-Arton concluded by highlighting the importance of addressing Tolsen's underlying issues, stating, “I think it is in society’s interests to have some work done on you, so you have a greater insight into your many difficulties.” Keith Tolsen, of Woodlands Terrace in Darlington, remains under supervision, with authorities monitoring his compliance with the court's orders as part of ongoing efforts to prevent further harm and protect vulnerable children in the community.
