A man from West Cumbria, Josh Atkinson, has been sentenced to prison after being convicted of raping a young girl when he was just 16 years old.

The criminal incident took place in 2017, and Atkinson, now aged 22, faced the consequences of his actions in Carlisle Crown Court.

Despite his pleas of not guilty, a jury found him guilty following a trial, as prosecutor Tim Evans detailed the harrowing circumstances surrounding the case.

According to the testimony presented during the trial, the victim was of primary school age at the time of the assault.

Evans described how the girl tried to resist Atkinson’s advances, telling him “no” and attempting to push him away.

However, being older and physically stronger, Atkinson overpowering the girl resulted in her suffering the assault over a period of approximately 15 minutes.

Her ordeal was a traumatic event that she carried with her long after it occurred.

It was only later, during a sex education lesson at her school, that the girl became overwhelmed with emotion as she realized the significance of what had happened.

She then confided in her mother, revealing the details of the assault.

The disclosure had a profound impact on both the girl and her mother, with the mother describing how difficult it was to witness her daughter's emotional decline.

She observed her daughter “go into herself” and struggle to manage her feelings, often becoming upset or angry.

The impact on the victim was severe.

Evans conveyed that the assault had left her feeling more insecure, plagued by intrusive thoughts, and plagued by distrust in boys and fears related to sexual matters.

She withdrew socially, choosing to stay indoors for an extended period.

The trauma also led her to self-harm on a couple of occasions, signaling the depth of her psychological distress.

In the courtroom, the defense emphasized Atkinson’s age at the time of the offense—just a few months shy of his 17th birthday—and argued that he should be sentenced as a juvenile rather than an adult.

Defense counsel Peter Wilson highlighted the defendant’s immaturity and impulsiveness as factors contributing to his actions.

Wilson also provided insight into Atkinson’s turbulent childhood, describing a life marked by instability, family violence, and exposure to illicit substances.

He explained that Atkinson’s father was described as a career criminal who struggled with his own drug dependency.

Wilson further elaborated on the long-term effects this turbulent background had on Atkinson, including the onset of depressive symptoms from the age of 12 and recurrent suicidal thoughts throughout his life.

Despite these challenges, Atkinson is now undergoing medication and attempting to turn his life around while serving his prison term.

The presiding judge, Guy Mathieson, acknowledged that Atkinson maintained his innocence regarding the offense, but remarked that the jury’s verdict was supported by “compelling evidence.” As a result, Atkinson was sentenced to four years in prison—half the sentence that would typically be imposed on an adult for the same offense.

Additionally, the court imposed a lifelong requirement for him to register as a sex offender, along with a five-year sexual harm prevention order and a restraining order that prohibits any contact with the victim during the same period.
