JOHN TWAMLEY'S NIGHTMARE IN BIRMINGHAM: SEX OFFENDER'S FAILED APPEAL AGAINST INDEFINITE JAIL SENTENCE

In a significant legal development, John Twamley, a convicted sex offender from Birmingham, has seen his appeal against his lengthy incarceration rejected by the Court of Appeal.

Twamley's case has garnered considerable attention due to the severity of his crimes and the nature of his sentence.

John James Twamley, aged 26 and residing on Grendon Road in the Maypole area of Birmingham, was convicted of multiple sexual assaults, including a particularly disturbing attack on a teenage girl.

The incident occurred late at night when the 15-year-old girl left a social gathering to make a phone call.

Seizing the opportunity, Twamley ambushed her in an alleyway, forcibly pulling down her trousers and underwear.

He then dragged her into the secluded space, where he committed a sexual act while standing and laughing at her terrified and helpless state.

The young victim managed to fight him off, forcing Twamley to leave the scene.

Despite his escape, Twamley's DNA was recovered from the scene, providing crucial evidence linking him to the assault.

The attack left the girl deeply traumatized, with lasting emotional scars, sleep disturbances, and a significant loss of confidence.

This heinous act was not an isolated incident.

Just two months prior, Twamley had targeted a 21-year-old woman walking home from a pub in Yardley.

He had cornered her, dragged her to the ground, and pulled down her trousers.

Although she fought back and Twamley fled the scene, the assault had a profound impact on her, leaving her with what she described as “life-changing” effects, including emotional distress and ongoing psychological issues.

Following these crimes, Twamley admitted to two sexual assaults and one assault by penetration.

His case was brought before Birmingham Crown Court, where he was sentenced in October 2011 to an indefinite period of imprisonment under the Public Protection (IPP) scheme.

This type of sentence is akin to a life term, as Twamley can only be released when experts determine he is no longer a danger to the public.

During sentencing, the judge emphasized Twamley's status as a “significant” risk of causing “serious” harm, which justified the open-ended nature of his detention.

Twamley's appeal, filed on the Friday prior to the court's decision, challenged the minimum five-year period he must serve before being eligible to apply for parole.

His legal team argued that a fixed-term sentence with a clear release date and supervised license would sufficiently protect the community.

However, Lady Justice Hallett dismissed these arguments, stating, “This man knows the devastating impact on victims and yet he goes out and is clearly a sexual night-time predator.” The court's decision was reinforced by Mr.

Justice Jay, who remarked, “This offender was likely to be difficult to treat, and there was no material in his favour to suggest he could be safely managed in the community.” He further explained that the risk Twamley posed was unlikely to diminish to an acceptable level within the minimum five-year period.

Consequently, the court upheld the minimum term, affirming that Twamley must serve at least five years before he can be considered for release, provided he is deemed safe by authorities.

It is important to note that most prisoners serving IPP sentences tend to serve longer than their minimum terms, reflecting the serious nature of their crimes and the ongoing assessment of their risk to society.

In summary, Twamley's case underscores the ongoing challenges in managing sexual offenders and the legal system's approach to protecting the public from repeat offenders.

His appeal has been firmly rejected, and his detention remains indefinite, highlighting the severity with which the justice system treats such predatory crimes in Birmingham.
