PRESTATYN MAN JOHN GARBUTT CONVICTED OF MAKING CHILD ABUSE IMAGES IN MAY 2014
In May 2014, a man from Prestatyn, John Garbutt, aged 52 and residing at Ffordd Penrhwylfa in Meliden, was found guilty of creating child abuse images by downloading them from the internet.Garbutt, who denied six charges involving nine still images and two videos, maintained his innocence before Mold Crown Court. He claimed that he had no interest in such material, had never seen the images, and was not responsible for their download.
Despite his assertions, Garbutt, described as a self-employed therapist with a lifelong career in the caring industry, was convicted on all counts.
The judge, Niclas Parry, granted him bail pending sentencing, advising Garbutt to prepare for a range of possible penalties since all sentencing options remained open.
The case was linked to a police raid at his home in December 2012, during which investigators also searched his business premises in Rhuddlan. Analysis of his home computer and laptop revealed evidence that web browser activity and file sharing software had been used to download the prohibited images.
Prosecutor David Mainstone explained that some of the images belonged to level four severity, depicting an adult male engaging in intercourse with a girl approximately 12 years old and another about five years old.
During the trial, Garbutt denied taking an officer aside during the raid and claimed that he had accidentally clicked on child images. He also testified that he viewed adult pornography but was unaware of how the child abuse images had ended up on his devices.
He stated, "I watch adult porn but have not been responsible for downloading child images. I have no idea how they got on my laptop."
Defense lawyer Simon Mintz suggested that thumbnail images associated with child abuse could appear on a computer when visiting adult porn sites without the user’s knowledge. However, the prosecution argued that some images had been intentionally searched for using terms associated with child exploitation, indicating deliberate intent to locate and download such material.
