A man named John Allan from Ayr was convicted of raping a 61-year-old woman suffering from dementia in his flat following an encounter during an early morning walk.
The woman, who was unable to give evidence in court because of her condition, provided a police statement describing how she bumped into Allan while out for a walk at around 5:15 am and explained her dementia.
She recounted that Allan engaged her in conversation about sex, which she did not understand, and then proceeded to undress her and himself, leading to rape.
Allan claimed that the sex was consensual and that she had instigated it, but the jury at Glasgow's High Court did not believe his account and found him guilty of rape.
The incident took place on June 19, 2017, at Allan’s flat in Murray Street, Ayr.
