In a highly charged courtroom scene in Cornwall, intense emotions erupted following a controversial judicial decision concerning Jamie Kenneth Tonkin, a 34-year-old man accused of heinous crimes involving the sexual abuse of two young girls.

Tonkin, a builder and tile layer from Cornwall, had pleaded guilty to multiple charges at Truro Crown Court.

Specifically, he admitted to three counts of indecent assault against one of the girls and a separate charge of gross indecency involving the other.

The assaults spanned several years, primarily occurring between 1997 and 2003, with one incident reported in 2006.

At the time of the initial abuse, both victims were under the age of seven, highlighting the severity and the disturbing nature of the crimes.

The case came to light last year when one of the victims, after years of silence, confided in a teacher about the abuse she had endured.

This revelation prompted police investigations, which confirmed the allegations and led to Tonkin’s guilty plea.

Despite the gravity of the offenses, the courtroom was stunned when Judge Jeffrey Rucker announced that Tonkin would not face imprisonment.

Instead, he was sentenced to a community order and ordered to attend a sex offenders’ course.

As Judge Rucker delivered his judgment, family members of the victims, who had been sitting in the courtroom, reacted with outrage.

Several stood up and vocally expressed their disapproval, shouting at the judge and Tonkin before storming out of the courtroom.

One family member shouted, “He’s got away with it – you’ve let him get away with it,” to which Judge Rucker responded calmly, “I have not – he has not got away with it.” Following the outburst, Tonkin was escorted from the dock by two security guards, highlighting the tense atmosphere within the court.

The judge acknowledged the emotional turmoil faced by the victims’ families and attempted to justify his decision by describing the case as being at the “lower end of the scale” of child sexual abuse.

He emphasized that all such abuse was dreadful but suggested that this particular case did not warrant a custodial sentence.

Pre-sentence reports revealed that Tonkin had been a heavy cannabis user during the period when the abuse occurred.

Judge Rucker commented on this, stating, “Cannabis is an extremely dangerous drug, particularly with persistent use.

I have known that for over 25 years.

This Government for some reason only woke up to the fact five years ago.

Having done so, ministers decided to class cannabis as a C class drug and not a B class.

It showed the depth of unjoined-up thinking.” The mother of the two victims, overwhelmed with emotion, broke down in tears after the hearing.

She expressed her disbelief and profound disappointment, saying, “I cannot believe the courts are not going to send him to jail for what he has put my daughters through.

To subject innocent children to the sort of abuse he carried out and then not to go to jail is beyond belief.

We thought we would get justice here today.

I feel we have been very badly let down by the courts.

My daughters may never get over this – we have to live with what he’s done, and he’s going to be walking around as free as a bird.

I’m sickened – really sickened.” Meanwhile, the case was adjourned for four weeks to allow the probation service to find a suitable placement for Tonkin outside Cornwall, as part of his community order.

During the proceedings, it was revealed that after confessing his crimes to police, Tonkin had begged to be taken into custody, citing threats he had received.

Defense lawyer Paul Rowsell stated that Tonkin was remorseful and believed that attending a sex offenders’ course outside prison would be more beneficial than an inside facility.

He emphasized, “The shame and remorse he feels can be gauged by the fact he confessed to what he had done.” Judge Rucker acknowledged the remorse expressed by Tonkin and expressed hope that the offender could rehabilitate if he accepted help.

He also noted that such confessions are rare, as most offenders tend to deny or drag out their cases in court, forcing victims to relive their trauma.

In his remarks, the judge also addressed the influence of drug use, specifically cannabis, on Tonkin’s behavior.

He described cannabis as “an extremely dangerous drug, particularly with persistent use,” criticizing the government’s classification of the drug as a C class substance, which he viewed as a flawed decision.

The mother of the victims voiced her outrage, questioning the message sent to children who have been abused.

“What kind of message does this sentence send to children who have been abused by a paedophile?

The message is ‘Don’t bother telling anyone because by the time these perverts are in front of a judge, all they get is a slap on the wrist.’ I don’t know how I’m going to tell my girls that the man who did these horrible things to them has got away with it.

How dare Judge Rucker say what my girls have suffered is not as bad as in other cases.

All sexual abuse of children is bad, and those who commit it should be punished with a jail sentence.” A relative of the victims also criticized the judge’s comments, asserting, “It seemed the judge was blaming cannabis for what Tonkin did.

Cannabis does not turn people into paedophiles.

The judge has lost the plot if he thinks that.”
