April 2012 James Tough jailed for indecent assault on a child in Arbroath A man who sexually assaulted a drunk 12-year-old girl has been jailed for three years and nine months. James Tough, 23, from Arbroath, sexually assaulted the girl in a bathroom of a house in the town. The girl had earlier been drinking alcohol with friends in a park, and went into the house after police moved to confiscate the alcohol. Passing sentence, Lord Uist ordered that Tough remain on the Sex Offenders Register for the rest of his life. At the High Court in Edinburgh the judge also said Tough should be supervised by the authorities for three years following his release from prison Tough had pleaded guilty to a charge of indecent assault at an earlier hearing. Defence advocate Ronnie Renucci said that although Tough was aged 22 at the time of the offence, he had a very low IQ. Mr Renucci said the difference in maturity between him and the girl was not as great as their ages might suggest. Lord Uist said: “The public need to be protected from behaviour of this kind.”
