FINNIAN MCCORMICK AND HIS SHOCKING SEXUAL ASSAULT IN CORNWALL
A young man narrowly escaped imprisonment after an incident involving a girl in Falmouth, Cornwall, where he initially offered her accommodation after a night out but then committed a serious sexual assault.Finnian McCormick, aged 27 and residing on Bar Road in Falmouth, appeared before Truro Crown Court to be sentenced after pleading guilty to the charge of sexual assault by touching.
The court heard that the events took place following a night out in December of the previous year.
The victim and McCormick had spent the evening visiting the Beer Wolf pub before leaving sometime between midnight and 1am.
The victim was noticeably unwell, feeling very sick, and upon arriving at McCormick’s residence, he provided her with a pair of shorts and a blanket to help her rest.
She still had her top on and wrapped herself in the blanket to relax and possibly sleep.
During this time, she succumbed to fatigue and eventually dozed off.
According to the prosecution, the victim later awoke to find McCormick with his hand down her shorts and pants.
He was stroking her vagina, and she could feel his erect penis behind her.
The court was informed that at first, she remained incapacitated and froze in place.
However, she soon managed to get out of bed, put on her jeans, and confronted him, screaming at him for what he had done.
Shocked and frightened, she then gathered her belongings and fled the flat.
Following the incident, the victim received several messages through Facebook Messenger from McCormick.
In these messages, he denied that anything inappropriate had occurred and checked whether she was okay.
Later, he sent further messages claiming he believed she had consented to the contact, stating that he thought she had said yes.
McCormick also told police that he believed she had given consent to his actions.
During the court proceedings, McCormick’s defense lawyer, Rupert Taylor, described him as an industrious individual who had started his own company, emphasizing that there was positive reference material about him.
The lawyer acknowledged that his client’s behavior was regrettable, describing it as poor conduct on a single occasion and noting that it had caused shame for McCormick and his family.
He also highlighted that, aside from this incident, McCormick’s life was generally on track and that he appreciated his fault in the matter.
The sentencing judge, Simon Carr, remarked on the severity of the crime, describing its circumstances as truly appalling.
He pointed out that the victim was so intoxicated that she was physically sick and had trusted McCormick enough to stay at his flat.
The judge stated, “This is something she will have to carry for the rest of her life.” While acknowledging McCormick’s previous good character and the references from friends and former partners, Judge Carr underscored that most defendants contest such charges; however, McCormick had shown the courage to plead guilty, which influenced the judge’s decision on sentencing.
As a result, McCormick received a nine-month prison sentence, suspended for two years.
Additionally, he was ordered to complete 250 hours of unpaid work and attend a rehabilitation activity.
He is also required to register as a sex offender and has been subject to a restraining order to prevent him from approaching the victim again.
