TEENAGER SENTENCED TO FIVE YEARS FOR RAPING WOMAN WHILE SHE SLEPT
Dylan Nesbitt, a teenager from Motherwell, was convicted of raping a woman while she was asleep in Newarthill.The incident occurred after a 21st birthday party on May 20, 2017.
Nesbitt, 19 years old at the time and residing on Montalto Avenue, raped the victim, who was 23 years old and a stranger to him.
The High Court in Glasgow sentenced him to five years in prison.
The judge, Lord Mulholland, stated, “You were found guilty by a jury of raping a young woman whom you had not met before that night.
A young woman who had not shown you any interest whatsoever, a young woman who was asleep and you took advantage of this situation to have sexual intercourse with her.” Following his conviction, Nesbitt was placed on the sex offenders’ register.
The victim recounted waking up to find Nesbitt engaged in sexual acts with her, shouting at him to leave the room, describing the experience as, “the worst thing that has ever happened to me.” Witnesses described her as being “hysterical and crying,” with one saying her screams resembled those from a horror movie.
Nesbitt claimed their encounter was consensual, but his victim firmly denied this, stating, “That is an absolute lie.” He was also cleared of another charge of raping a 15-year-old girl in a park behind Dalriada Crescent, Motherwell, on June 9, 2017, with the jury finding the evidence not proven.
Defense QC Derek Ogg mentioned that Nesbitt was assessed as a low risk of reoffending.
