DANIEL BIRCH SENTENCED IN WREXHAM FOR SEXUAL ASSAULT ON 15-YEAR-OLD GIRL AT FLINTSHIRE PARTY
In a case that has shocked the local community, Daniel Birch, a 24-year-old man from Overton Way in Wrexham, was sentenced to three years and two months in prison for engaging in sexual activity with a 15-year-old girl.The incident occurred after Birch met the young girl at an outdoor gathering in Flintshire last July, an event that has since garnered significant attention from law enforcement and the public alike.
During the court proceedings at Caernarfon Crown Court, Birch admitted to the charge of sexual activity with a child, a serious offense that carries severe legal consequences.
The court was informed that the girl involved was heavily intoxicated at the time of the incident, having consumed a mixture of red wine and vodka.
Due to legal restrictions, her identity remains protected, but the court heard details about her condition that underscored her vulnerability during the event.
Judge Huw Rees, presiding over the case, sentenced Birch to 38 months in prison.
In his remarks, the judge emphasized that Birch had exploited the girl’s age and her impaired state, describing the act as a clear abuse of her vulnerability.
The judge also expressed concern that Birch appeared to have deliberately targeted the young girl, raising questions about his intentions and conduct during the encounter.
In addition to the custodial sentence, the court imposed an indefinite Sexual Harm Prevention Order on Birch, which aims to restrict his future interactions and protect the community from potential harm.
Furthermore, Birch is required to register as a sex offender, a measure that will have long-term implications for his personal and social life.
Prosecutor Mark Connor provided further details about the incident, explaining that the girl had attended a party in Flintshire with friends the previous July.
By the time Birch arrived around 9 pm, she was already intoxicated.
Witnesses reported that Birch engaged in conversation with her, and it was revealed by another girl at the party that the victim was only 15 years old.
The court heard that the girl was so intoxicated that she was unable to walk or speak properly, indicating the severity of her drunken state.
As the night progressed, the girl was separated from her friends and attempted to contact them during the early hours of the morning.
Despite her impaired condition, she managed to make her way home.
Her parents, upon discovering the details of the party and her condition, contacted the police later that day.
Birch was arrested and taken into custody, where he initially denied any sexual activity had occurred.
He claimed that forensic tests would prove his innocence.
However, the evidence presented in court, including forensic analysis, confirmed that sexual activity had indeed taken place between Birch and the young girl, leading to his conviction and subsequent sentencing.
