CRAIG MACKAY FROM METHIL SENTENCED TO LIFE FOLLOWING RAPE CONVICTION IN GLASGOW
A bodybuilder from Fife, convicted of four sexual offenses, faces the possibility of life imprisonment after a judge imposed strict conditions on him.Craig Mackay received a five-year sentence, and the court also granted a lifelong restriction order at the High Court in Glasgow, which will involve community monitoring after his release.
Mackay, who is currently detained at HMP Edinburgh, challenged the delay in his rehabilitation, claiming that the Scottish Prison Service had failed to facilitate his progress because he insists on maintaining his innocence.
He argued that because he refuses to admit guilt, he cannot participate in rehabilitative programs that might support his prospects for parole, violating his rights under Article 5 of the European Convention on Human Rights.
He sought a judicial review and a claim for £2,000 for compensation and expenses, but this was dismissed by a judge in the Court of Session.
Mackay had previously served time for assault involving domestic violence and has convictions related to domestic violence and disorder.
He maintains his innocence regarding the rape charges, despite admitting to abusive behavior in the past.
Medical assessments have identified severe personality disorders, including antisocial and psychopathic traits.
Though eligible to apply for parole in March 2025, Mackay did not do so, citing the lack of community management options.
A court hearing noted that he was suitable for the Self Change Programme aimed at violent offenders, but was deemed unfit because he could not identify areas for personal risk reduction or accept responsibility for his actions.
The court emphasized that the prison authorities recognize the importance of responsible behavior and provide alternative avenues for rehabilitation, which Mackay has not fully engaged with, especially due to his continued denial of guilt.
In conclusion, the judge ruled that Mackay's inability to participate in the SCP because he maintains innocence does not justify denying him access to other rehabilitation methods.
While he has not shown full cooperation, there are other ways to demonstrate risk reduction, and maintaining innocence does not preclude access to these.
The court affirmed that Mackay's continued misconduct in custody is a matter within his control and that he has the opportunity to persuade the Parole Board of his rehabilitation through proper conduct, even without completing the SCP.
