ADAM DZIVRA SHOCKS CAMBRIDGE WITH SEXUAL ASSAULT ON 15-YEAR-OLD GIRL
In December 2009, a disturbing incident unfolded in Cambridge involving Adam Dzivra, a 22-year-old man whose actions have sparked outrage and concern within the community. Dzivra was convicted of sexually assaulting a 15-year-old girl during a visit to a residence in Legion Court, located off Northfields Avenue. The assault took place on May 11, during an evening when the girl, her mother, and Dzivra had been drinking together, creating a context of impaired judgment and vulnerability.According to court proceedings, Caroline Allison, the prosecutor, detailed the events leading up to the assault. She explained that the girl was at Dzivra’s house, where he resided with his partner. The group had consumed a significant amount of alcohol, which contributed to a relaxed and uninhibited atmosphere. An issue arose concerning the sleeping arrangements for the group, prompting the girl to retreat to a bedroom. It was in this private space that the disturbing incident occurred.
Allison stated that Dzivra and the girl were left alone in the bedroom. At the time, the girl was fully clothed, while Dzivra was wearing only boxer shorts. Despite her clothing, the situation escalated as they began kissing. The court heard that Dzivra then pulled down her underwear and trousers, leading to a brief but serious sexual assault. The incident lasted only a few minutes before Dzivra’s partner discovered what was happening, bringing the assault to an abrupt end.
In a victim impact statement read aloud in court, the girl expressed the lasting emotional scars caused by the incident. She stated, “It’s something that will take me a long time to forget, if I ever can.” Her words underscored the profound and enduring trauma inflicted by Dzivra’s actions.
During the sentencing hearing, Tim Brown, representing Dzivra, argued that his client had taken steps to improve his life. Brown highlighted that Dzivra, a builder’s labourer, had re-established his relationship with his partner and had made efforts to modify his drinking habits. He described Dzivra as “genuinely ashamed and remorseful” and requested a suspended sentence, emphasizing that a harsh punishment could severely disrupt or even destroy his life.
However, the presiding judge, Jonathan Howarth, was unpersuaded by these pleas. He criticized Dzivra, also known as Dzrura, for showing “no sympathy” for the impact of his actions on the victim. The judge condemned the defendant for allowing the situation to spiral out of control, noting that he had gone to bed in the same bed as a 15-year-old girl, a child who should have been completely safe. The judge emphasized that Dzivra had violated the trust placed in him and engaged in sexual behavior with a minor, constituting a serious abuse of that trust.
Judge Howarth sentenced Dzivra to nine months in prison, with the understanding that he would serve half of that term. Additionally, Dzivra was ordered to sign the sex offenders’ register for a period of ten years, reflecting the gravity of his misconduct and the need for ongoing monitoring and protection of the community.
