TREVOR SMITH JAILED IN LIVERPOOL FOR INDECENT EXPOSURE AND LEWD BEHAVIOR
A 50-year-old man named Trevor Smith was sentenced after he was caught engaging in disturbing behavior while residents nearby looked on.On the evening of March 18 this year, an eyewitness reported seeing Smith, who was 'sweating' and 'fully naked', performing a sex act on himself while leaning out of his balcony window.
The witness, distressed by what she saw, stated she 'felt physically sick' and contacted police.
Officers arriving at the scene found Smith 'wearing a towel', 'out of breath', and sweating heavily.
A subsequent search of his flat revealed a bag of cannabis and explicit content displayed on his mobile phone.
The incident was detailed in court by prosecutor Chris Hopkins at Liverpool Crown Court.
He explained that the witness, who lived in an adjacent apartment, was alerted to noise around 9:50 pm and looked out her window.
She observed approximately nine teenagers—both males and females—walking past on the street.
Then she saw Smith hanging out of his window with his hand on the ledge, leaning over and looking down.
The prosecutor added that when Smith retreated from his balcony, he was fully naked with his boxer shorts pulled down to his knees, and appeared to be performing a sex act on himself.
The witness, horrified by the scene, said it was 'disgusting' and that he had been 'looking towards the group of kids passing by.' She expressed concern that since the incident occurred near a busy road, anyone could have seen what he was doing.
Following the police discovery, Smith was found to have a history of similar offenses.
He previously received a 12-month conditional discharge in 2012 for outraging public decency.
In June 2016, he was sentenced to a three-year community order for a comparable offense, but later breached it by failing to comply, alongside convictions for drink and drug-driving, resulting in a three-month jail term.
Further, in October 2019, he was given a 26-week suspended sentence after being caught intoxicated in a train station lift while thrusting his hips towards a work cone, an act witnessed by members of the public.
Smith breached his suspended sentence with the March 18 offense and was remanded into custody.
He will also serve part of his 2019 sentence that was originally suspended.
His defense attorney, Mark Philips, argued that the teenage group was unlikely to have seen Smith because he lived on a higher floor and the time was late.
Mr.
Philips also noted that Smith had reflected on his behavior in prison, attributing his past offenses to drug abuse, and that he had begun a drug awareness program and rehabilitation activities to turn his life around.
At sentencing, Judge Stuart Driver remarked that the crimes were aggravated by Smith's focus on the passing teenagers and his prior criminal record.
He sentenced Smith to 10 months in prison and ordered him to sign the Sex Offenders Register for 10 years.
Additionally, Smith admitted possessing cannabis, exposing himself, and breaching his suspended sentence, leading to his current imprisonment.
