In January 2023, a heated debate emerged over the planned transfer of a high-risk transgender inmate from a male prison to a female facility in Scotland. The individual in question, Tiffany Scott, formerly known as Andrew Burns, is currently serving an indefinite sentence and is housed in a prison in Clackmannanshire. The Scottish government has faced calls to intervene and prevent her transfer to a women’s jail, citing safety concerns and public safety risks.

It is understood that Tiffany Scott has formally requested to be moved to a women’s prison, a move that has already received approval and is expected to take place later in the year. The decision has sparked criticism from the Scottish Conservative Party, which has publicly urged authorities to reconsider the transfer, arguing that it could pose safety threats to both staff and other inmates.

A spokesperson for the Scottish government responded to the controversy by stating that the matter is an operational decision handled by the Scottish Prison Service. They emphasized that the placement of transgender prisoners is determined on a case-by-case basis, taking into account individual circumstances and safety considerations.

Scott, who is serving her sentence under a lifelong restriction order (OLR), is considered a significant risk to public safety. The OLR means she will only be eligible for release once authorities determine she no longer poses an unmanageable threat. Her criminal history includes a series of violent and disturbing incidents, which contributed to her indefinite detention.

In 2013, Scott was sentenced after admitting to stalking a 13-year-old girl by sending her letters from her cell. Her history of violence escalated in 2017 when she was sentenced at Falkirk Sheriff Court following a series of violent episodes at Glenochil Prison in Clackmannanshire. These incidents included striking a prison nurse with a hurled chair, assaulting a prison officer by punching him in the face, and spitting at another officer while attempting to bite him.

Additionally, Scott engaged in acts of self-harm and defiance, such as smearing excrement over her cell, tearing out a drip needle from her arm, and ripping up “tear-proof” clothing. These behaviors underscore her reputation as a dangerous and unmanageable inmate, which has fueled the debate over her placement in a women’s facility. The controversy continues to unfold as authorities weigh safety, legal, and ethical considerations surrounding her transfer.
