THOMAS TOMLIN SHUFFLING PENSIONER FROM BRIDLINGTON ESCAPES JAIL AFTER SEXUAL ABUSE OF EIGHT-YEAR-OLD GIRL
In a case that has shocked the community of Bridlington, Thomas Tomlin, a 63-year-old man, was convicted of sexually abusing an eight-year-old girl nearly two decades ago. Despite the gravity of the charges, Tomlin was spared immediate imprisonment due to his severe health issues.During the hearing at Hull Crown Court, it was revealed that Tomlin suffers from chronic obstructive pulmonary disease (COPD), a condition that significantly impairs his lung function, which has deteriorated to the level typically seen in a 90-year-old. His physical condition was a key factor in the judge’s decision to avoid a custodial sentence.
The presiding judge, Judge Michael Mettyear, known as the Honorary Recorder of Hull and the East Riding, addressed Tomlin directly, stating, “It is very, very rare for me to pass sentence in a case like this without sending a person straight to prison. It is almost a unique experience to do so. You now, at the comparatively young age of 63, look like, walk like and shuffle like an old man. Time has not been kind to you. Although I’m tempted to lock you up, I can’t see who it would help.”
Tomlin, who has a history of alcoholism, admitted to three charges of indecent assault against the young girl. The court heard that the abuse took place approximately 20 years ago, but the details of the case were brought to light during the proceedings.
In light of his health and the circumstances, the judge sentenced Tomlin to 12 months in prison, but this sentence was suspended for two years. Additionally, he was ordered to participate in a sex offender treatment program as part of his rehabilitation.
While the decision has sparked mixed reactions, the court emphasized the importance of considering the defendant’s health and the potential for rehabilitation in cases where the offender’s physical condition is severely compromised.
