MAN STALKED WOMAN FOR WEEKS BEFORE BREAKING IN AND ATTACKING HER NEW BOYFRIEND

A man who broke into his ex-partner’s Salisbury home on the morning of January 12, 2024, and committed violent acts including twice throwing her down stairs and assaulting her new partner, has been sentenced to prison.

Rastislav Kubicek, aged 44, shattered a window to gain entry around 6am, after which he physically assaulted the woman by pulling her by her hair and pushing her down the stairs, resulting in minor injuries.

He then attacked her new partner, leading to a fight that lasted up to ten minutes, during which the victim sustained a broken hand and bruising around his eyes while defending himself.

Police arrived during the incident, after which Kubicek was taken into custody, cautioned, and held under section until they considered him fit for questioning.

On October 9, Judge Adam Feest sentenced him to two years and four months in prison after he pleaded guilty to assault and stalking.

The judge highlighted that the break-in was worsened by the presence of two children and characterised the incident as the climax of a series of concerning behaviours.

While acknowledging Kubicek’s mental health issues and that his violence was out of character, the judge also noted that he appears to harbour misogynistic views and a sense of entitlement.

He emphasised that Kubicek was a trespasser with no right to be in the house, describing the attack as prolonged and persistent.

Additionally, the court imposed a 10-year restraining order.

Victims’ statements were read aloud: the woman described him as a “psycho” and expressed ongoing fear, feeling he is trying to control and ruin their lives.

The male victim recounted the trauma, mentioning his broken hand and the financial impact of missing work, losing clients as he rebuilds his business.

Defense lawyer Holly Fagan argued that Kubicek was experiencing a “transient psychotic episode” and that his mental health struggles are ongoing, suggesting his injuries during self-defense were unusual.

The judge responded by noting that his vigorous self-defence, which resulted in breaking his own hand, speaks volumes about the severity of the incident.
