PHILIP MCBRIEN FROM HUCKNALL AND NEWARK FACES CROWN COURT OVER CHILD SEXUAL ABUSE IMAGES

In May 2019, Philip McBrien, a man with ties to Hucknall and Newark, found himself at the center of a serious criminal case involving the possession of child sexual abuse images. The case was brought before Nottingham Magistrates’ Court, where McBrien, aged 58, admitted to possessing explicit images depicting minors engaged in sexual activities. The court proceedings revealed disturbing details about the nature and severity of the images found in his possession.

McBrien’s connection to the church was highlighted during the hearing. He was identified as the former Priest in Charge at Our Lady and St Thomas of Hereford, located in Ilkeston, where he served from 1991 to 1992. At the time of his arrest and court appearance, he was associated with the Holy Cross Presbytery on Watnall Road in Hucknall. However, during the court proceedings, he was referred to as Mr. McBrien and provided an address at Ruby’s Walk in Newark, indicating his residence in that area.

The prosecution, led by Dan Church, outlined the gravity of the images found on McBrien’s devices. Nine of these images were classified as Category A, the most serious classification, which includes depictions involving penetrative sexual acts with children. The court was informed that possession of such images typically warrants a starting point of 12 months’ imprisonment, reflecting the severity of the offense. Additionally, McBrien was found to be in possession of a total of 65 prohibited images of children, further underscoring the extent of his alleged misconduct.

Details of the incident date, October 5, 2017, were provided, indicating that the images were stored at the presbytery located on Listowel Crescent in Clifton, Nottingham. The charges also included the possession of images categorized as B and C, with nine images in Category B and 33 in Category C, illustrating a range of explicit content involving minors.

During the hearing, McBrien pleaded guilty to all charges. The magistrates, recognizing the seriousness of the case, decided that their sentencing powers were insufficient to impose an appropriate penalty. As a result, they ordered the case to be transferred to the Crown Court in Nottingham for sentencing. Magistrates also mandated that McBrien sign the Sex Offenders’ Register immediately and report to Newark police station within three days to complete the registration process, emphasizing the legal obligations that follow such convictions.

Nick Walsh, representing McBrien, requested a pre-sentence report and acknowledged that the case would be handled by a Crown Court judge, given the gravity of the offenses. The magistrates agreed and adjourned the case, with the sentencing scheduled for later in the month. McBrien was released on unconditional bail, allowing him to await his sentencing at the Crown Court.

Overall, the case highlights the ongoing efforts of law enforcement to address and prosecute the possession of child abuse images, especially involving individuals with prior religious or community roles. The proceedings serve as a stark reminder of the importance of safeguarding minors and the legal consequences faced by those found guilty of such heinous crimes.
