NATHAN TOTTON BIDDULPH SEX OFFENDER SENTENCED AFTER OVERNIGHT STAY WITH MUM-OF-THREE

In January 2021, Nathan Totton, a known sex offender from Biddulph, was sentenced to six months in prison after breaching the strict conditions of his Sexual Harm Prevention Order and the Sex Offenders' Register. The incident involved him staying overnight at his partner's residence, which is a violation of the court-imposed restrictions designed to protect minors from potential harm.

Totton, aged 26, is legally prohibited from having unsupervised contact with individuals under the age of 16 due to his previous convictions and current legal orders. His criminal history includes a three-year prison sentence handed down in 2017, following his conviction for inciting a child to engage in sexual activity and actual sexual activity with a minor. These serious offenses have marked his criminal record and subjected him to ongoing legal restrictions.

Despite these restrictions, court proceedings revealed that Totton violated multiple conditions of his court orders after he met a woman on a dating website during the summer of the previous year. The breaches included failing to notify police authorities that he was staying at his partner’s home for more than 12 hours, which is a requirement for registered sex offenders. Additionally, he stayed overnight at her residence and came into contact with her children, actions explicitly forbidden under his legal restrictions. Furthermore, he neglected to complete his annual registration update on time, further breaching the terms of his supervision.

Prosecutor Peter McCartney detailed the extent of Totton’s violations, stating, “He stayed overnight at least seven times within a month after they met. In a determined attempt to conceal his actions, he breached the sex offenders’ notification requirements.” McCartney also highlighted that Totton explained his non-compliance by saying he did not want to undergo a risk assessment or jeopardize his relationship, revealing a concerning attitude towards his legal obligations. The defendant reportedly told police, “I have done my sentence. Why should I be punished for the rest of my life?”

During the court hearing, Totton, of William Street, Biddulph, pleaded guilty to three counts of failing to comply with the notification requirements of the Sex Offenders’ Register. In addition to his jail sentence, he was subjected to a five-year restraining order, which prohibits him from contacting or approaching the woman involved in the case.

Judge David Fletcher addressed the court, emphasizing the importance of compliance with legal restrictions. He stated, “You felt your life was being controlled by the requirements placed upon you. Any further breach of the notification requirements can result in a more onerous sentence being imposed on you.” The judge’s comments underscored the seriousness of the violations and the potential consequences of continued non-compliance.

In a related case from November 2017, Totton, then aged 22, was convicted of sending explicit images to a schoolgirl and inciting her to engage in sexual activity. The court heard that he sent the girl photographs of his genital area along with lewd language, fully aware of her age. The sexual contact involved touching over clothing, which further compounded the severity of his offenses. Following a trial, he was sentenced to three years in prison and was placed under a Sexual Harm Prevention Order, with a lifelong requirement to register as a sex offender. These convictions highlight a pattern of concerning behavior and the ongoing legal restrictions placed upon him to prevent further harm.
