MAN SENTENCED FOR DOMESTIC ABUSE AND ASSAULT IN ALYTH
Michael Smith, a 46-year-old man from Glenalmond Road, Rattray, was convicted of domestic violence at Perth Sheriff Court.The court heard that Smith had a history of abusive behavior towards his wife, Claire Smith.
In this recent incident, as reported, Smith was in a drunken rage when he repeatedly sang a derogatory song about his wife while assaulting her.
According to the prosecution, Smith feared that his wife was sleeping with other men behind his back, which led to his actions.
The court stated, “The accused and the complainer had been married for three years prior to this incident.
She left the house to meet friends and began drinking with them.
At 11pm she returned home.
She was confronted by the accused who appeared to have formed the opinion she was sleeping around.” The court detailed that Smith began calling her derogatory names and singing a song he had made up, which caused the victim to be unable to sleep.
The victim was injured when Smith hit her in the face; she had a red eye and swollen nose when police arrived.
Smith admitted to police that he had been verbally abusive to his wife.
As a result, Sheriff William Wood ordered Smith to complete 180 hours of unpaid community work.
The court also noted that Smith was no longer living with his wife and declared that there was no intention to resume co-habitation.
The outcome was a conviction for causing fear and alarm through repeated shouting and singing obscenities, coupled with assault causing injury.
The court's judgment was focused on his abusive and violent conduct, emphasizing the seriousness of his actions in a domestic setting.
