DUMBARTON MAN MARK MCCOLL ESCAPES JAIL DESPITE CHILD PORNOGRAPHY STASH IN SCANDAL INVOLVING LOCAL RESIDENTS

In a case that has shocked the community of Dumbarton, Mark McColl, a local resident from Bonhill Road, narrowly avoided imprisonment after being found in possession of an extensive collection of over 6,000 disturbing images depicting children. The disturbing discovery was made during police investigations, revealing that McColl had stored these illicit images on his computers and mobile phones, raising serious concerns about child exploitation and abuse.

Despite the gravity of the evidence, McColl was not sent to jail. Instead, he was handed a five-year ban from accessing the internet for any personal use, a measure aimed at preventing further access to such material. Additionally, he was placed under a strict sexual offences protection order that prohibits him from having any contact with individuals under the age of 16 during this period.

Sheriff Ruth Anderson presided over the case at Dumbarton Sheriff Court, where she expressed her concerns about the unknown identities and locations of the children depicted in the images. She emphasized the potential harm and exploitation that could have been inflicted upon these children, stating, “We have no idea who these children are and where they live. We have no idea what repercussions this may have in terms of abuse or exploitation they have suffered at the hands of adults. You are one of these adults.”

The court was also informed that, among the vast collection of images, there was a folder on McColl’s computer containing photographs of a child belonging to a friend, with the child's name tagged on the folder. This detail added a further layer of concern regarding McColl’s actions and possible connections to known children.

During the proceedings, McColl’s legal representative, Kenny Clark, highlighted the social and personal consequences faced by his client. Clark explained that McColl, who has been ostracized by friends and family, had chosen to step away from his employment due to the ongoing legal process. McColl, who has spent significant periods abroad for work, voluntarily declined employment for approximately five months, resulting in a loss of around £20,000 in income.

Clark further noted that McColl’s future employment prospects could be severely limited, citing restrictions on obtaining visas for certain countries and the likelihood of being confined to work within Britain, particularly around the shoreline and onshore areas. Despite these setbacks, Clark emphasized that McColl has shown remorse, expressed shame and embarrassment, and acknowledged the severity of his actions, especially concerning the child he personally knows. He described McColl’s behavior as an obsession and an addiction, indicating an awareness of the need for treatment and rehabilitation.

McColl, who appeared in court from custody, admitted to charges of taking or permitting the creation of indecent images of children, with offenses spanning from August 30 to September 30, 2005, and from January 1, 2001, to March 2012. The court was told that these actions involved images stored in his home, further underscoring the seriousness of the case.

In her sentencing remarks, Sheriff Anderson underscored the importance of the probation order, warning McColl that any breach of the conditions or the sexual offences protection order would likely result in a return to jail. She also pointed out that the short period of remand served by McColl should serve as a stark reminder of the consequences faced by individuals involved in such offenses, reinforcing the court’s firm stance on child exploitation crimes.
