KYLE SMITH BREACHES COURT ORDER IN CARDIFF AFTER USING SNAPCHAT TO CONTACT 15-YEAR-OLD GIRL
Kyle Smith, a 31-year-old resident of Cardiff, found himself back in legal trouble after violating a court-imposed order designed to restrict his contact with minors.The breach occurred when Smith used the social media platform Snapchat, which he was explicitly prohibited from accessing under the terms of his previous sentencing.
Smith's criminal history is extensive and disturbing.
He was previously sentenced to four years in prison after being convicted of seven separate acts involving the coercion of a young girl into engaging in penetrative sexual acts.
During that ordeal, he manipulated his victim into sending explicit photographs and used threats to intimidate her, warning that he would disclose these images to her family if she refused to meet him in person.
His latest violation was brought to light during a hearing at Newport Crown Court on a recent Thursday.
The court was informed that Smith had committed multiple breaches of his court orders, including failing to adhere to notification requirements and engaging in communication with underage children through calls and messages.
Prosecutor James Evans detailed that Smith was under strict conditions that forbade him from using any applications or software that did not retain communication history, a measure intended to monitor and prevent further misconduct.
On October 26 of the previous year, a 15-year-old girl reported to the police that Smith had been communicating with her via Snapchat.
This report prompted immediate police action.
Officers responded swiftly, visiting Smith's residence on Hansen Street in Butetown, Cardiff.
During the arrest, they seized two mobile phones and a tablet from his home.
Smith admitted to using Snapchat since 2021 but claimed ignorance of the fact that using the app was a breach of his court conditions.
However, the prosecution did not accept this explanation, emphasizing that Smith was fully aware of the restrictions imposed upon him.
Following his arrest, Smith pleaded guilty to breaching a Sexual Harm Prevention Order.
His criminal record is extensive, including convictions for affray, assaulting police officers, harassment, and burglary, in addition to his previous sexual offenses.
The court heard that Smith's actions demonstrated a continued pattern of offending behavior, despite the restrictions placed upon him.
Judge Matthew Porter-Bryant sentenced Smith to a total of 20 months in prison.
The sentence was structured so that Smith will serve half of this time in custody, with the remaining period to be served on licence, subject to supervision and conditions aimed at preventing further harm.
