PERTH MAN HOG-TIED BY MOTHER AFTER VIOLENT RUN-IN WITH FAMILY
A mother was compelled to hog-tie her 32-year-old son, Kevin Smart, and hold him to the ground until police arrived after he was involved in a violent altercation with his father.Marion Smart used an extension cable to restrain her son’s legs following his resistance when asked to go to bed.
Fiscal depute Andrew Harding told Perth Sheriff Court: "The accused is the son of Marion and David Smart and he was residing with them at the time." The court heard that Kevin Smart struggled violently with his father, David Smart, in Talisker Place, Perth, on October 13, 2019, and behaved threateningly at his home on February 24 of the previous year.
The incident began when Kevin Smart returned home around 3am, banging around downstairs, causing his father to attempt to calm him.
The situation escalated as he became aggressive, shouting and swearing, and required restraint by his family members.
Marion Smart described that Kevin kicked off when she asked him to go to bed, leading her to use the extension cable to bind his legs.
Police found Kevin being restrained by family members and noted the extension cable tied around him as he lashed out, trying to bite his father.
Kevin Smart admitted to struggling violently with his father and acting in a threatening or abusive manner at his home in Perth.
The sheriff placed him on a curfew from 7pm to 7am for four and a half months.
Solicitor Paul Ralph stated: "This behaviour was mainly due to drink and drugs.
He was more or less out of control.
He is living with his parents."
